I thank you for your response, but you say nothing. I know what is required, the
question is: If required data is not available what should one do? In my scenario,
the hospital does not know the birthdate of the subscriber (remember the subscriber is
the at fault driver in the accident - as another twist let's assume that the other
subscriber will not speak to the hospital on advice from his attorney). Should the
hospital send loop 2320 with missing data?

Date of Birth is required element in Required Segment DMG , which is present
in Situational loop 2320.
If you decide to send loop 2320 , you will have to send Date of Birth.
