And he'd be right.  It's no different than locking your door, if you left 
your door unlocked and someone broke in and took your stuff, you'd be 
responsible for that omission, your insurance wouldn't cover you etc. You 
need to do your own due dilligence, no one else is going to do it for you.  
This is irrelevant as to whether his act is illegal or not.
