by your isp under their tos maybe, or in a civil suit. crimnal 
prosecutions tend to look for a higher standard of proof than "this ip 
downloaded this file at this time".

potentially but not exceptionally. if you secure your interior facing 
interfaces thw same way you securce you internet facing interfaces... then 
your neighbors/customers shouldn't pose any more threat to you from a 
security standpoint then the internet as a whole does. basically you can't 
trust them to secure their computers any more than any other isp could, so 
you have the normal user host issues, worms, open relays etc.
