Fieldset and legend elements are useful for explicitly identifying groups of form controls and assigning a label [legend] that relates to a group of controls. The example of their use you provided looks fine. I'd like to use <fieldset> and <legend> to mark up each question, thereby separating them easily for people with assistive devices.
