key debate indeed,but my view is that these elements of undermining
organisational discipline creates a wrong precedence that shall not find
remedial measures in future because it does mean that if a particular
faction emerges in the organisation then we shall then run to judicial 
courts which by nature cannot be unbiased given the fact that these
institutions are products of the contradictions in society therefore they
have a particular lineage that locates the societal expressions on a
particular issue,then we may as well agree to the last decay of
organisation,because the creeping of this tendency is scientifically
irreversable given that is informed by subjectivism.even those that goes
to courts and the decision is on their favour they will still also at the
particular time of them leading find the expression of this because non
homogeneity in the organisation,more especially when the capital hegemony
forms part of the centrality of this tendency.

the only solution is that we must use the organisation platfom to fight
our own entitist elements and if we fail we must learn to swallow whatever
the outcome bitter as it may we must just swallow it.because this is the
organisation your entitist tendency shall find emergence at a particular
time,but by going to courts exacerbate the matter itself because it means
we start to beleive that external institutions may assist the with
instilling the discipline in the organisation,which is wrong view because
is tantamount to say judiciary informs the society,the societal
organisations are the ones which the judicial posturing is derived,now the
externalisation of our organisational discipline shall decay the
organisation,like other organisation which decayed and died today like the
movent of amilca cabral,of arab moi in kenya and many others which
externalised their organisation to locate solutions as part of their
factional battles and so on.

So we must continue with decaying element or rescue the organisation by
learning to understand that whatever happen in it not all of us will be
satisfied wit decisions,i can imagine if chris hani would have went to
court to challenge the decision of arm struggle disbandment or just took
his own faction and fought the decision the organisation took what would
have happened.
