I'm not sure but I've just solved similar problem. Footnotes have their 'own' bodyfontsize so if it isn't defined, ConTeXt uses default font. For example I defined \definebodyfont [13pt,12pt], while footnotes are 'small' by default, which means that they are 10pt. Footnotes were in cmr10 because I didn't defined 10pt body font.
