He is flat wrong. PERIOD. Not subject to discussion.

This PARTICULARLY is where he is - to use the old expression - SH*T 
out of luck.
He cannot lay claim to the frequencies - because as we all know - no 
one owns frequencies within the amateur spectrum. He is being 
high-handed and hasn't  legal leg to stand on.
