-Caveat Lector- Probe Finds Judge Not In Violation by PETE YOST Associated Press Writer WASHINGTON (AP) -- A federal judge didn't violate judicial ethics when she ignored normal procedures and sent three criminal cases against friends of then-President Clinton and Democratic fund-raisers to Clinton appointees, an inquiry concluded Monday. The 10-month probe found Chief U.S. District Judge Norma Holloway Johnson acted properly in assigning cases after learning in advance from prosecutors that indictments would be issued in the Whitewater and campaign fund-raising scandals. Evidence suggests that Johnson ''did not assign cases with a political or partisan motivation'' and didn't ''engage in any deliberate or even clear violation of any rules,'' said a nine-page decision by the Judicial Council, which is comprised of seven of Johnson's fellow judges. Johnson is a Democratic appointee of the Carter administration. Getting a heads-up about impending indictments ''fell well within the legitimate ministerial duties of the chief judge and indeed was followed by the prior chief judge,'' the decision added. The advance knowledge gave Johnson ''adequate time to consider the circumstances of the particular case, contact the receiving judge and notify the clerk's office well before the return of an indictment,'' the inquiry concluded. Ordinarily, cases are randomly assigned through a computer system in the clerk's office. A court rule that has since been scrapped allows the chief judge to circumvent the computer for protracted, complex cases. The ruling noted Johnson's recollections differed from those of prosecutors. Johnson ''repeatedly stated'' to investigators that she ''never met with prosecutors to discuss when indictments would be returned,'' the judges noted. The judges concluded Johnson's denials of advance knowledge were ''incorrect'' because ''a number of prosecutors'' in the fund-raising and Whitewater probes ''specifically recalled informing'' Johnson or her office of impending indictments, the judges said. However, they concluded no wrongdoing. Johnson's colleagues also examined her summoning of clerk's office employees and prosecutors to her chambers one-by-one and questioning them about the handling of cases after the inquiry of her actions was announced, but before former U.S. Attorney Joe Whitley began his probe for the court. Johnson questioned a member of the clerk's office on three occasions under oath. ''Each of the clerks interviewed'' by Johnson ''stated ... that they did not feel intimidated, coerced or otherwise improperly influenced,'' said Johnson's fellow judges. ''We do not believe that further investigation into the interviews would reveal any improper purpose.'' At the court's request, Whitley looked into nine criminal cases and concluded that Johnson specially assigned three of them: A tax case against longtime Clinton confidant Webster Hubbell and indictments against fund-raising figures Charlie Trie and Pauline Kanchanalak. Trie, a former Little Rock restaurateur, is a Clinton friend. Whitley found that Johnson ''may have exceeded'' her authority in assigning the Kanchanalak case to the same judge who handled the Trie prosecution. But Johnson's fellow judges said her action didn't support the allegation of political motivation. The inquiry found conflicting evidence on whether Johnson assigned several criminal cases, including that of Maria Hsia, a longtime fund-raiser for Al Gore. Prosecutors said they understood that Johnson had directed the Hsia case be sent to a particular judge, but Johnson denied it. ''We do not believe that the facts show that Chief Judge Johnson steered the Hsia case'' to U.S. District Judge Paul Friedman ''to further any political or partisan interests,'' said Whitley's 136-page report. ''The facts do not establish that Chief Judge Johnson had a role in the assignment of this case.'' Johnson attorney Mike Madigan said ''we are very pleased that after a lengthy detailed investigation, the Judicial Counsel has found that Chief Judge Johnson did not assign any case for political or partisan purposes and that she did not violate any provision of the Code of Judicial Conduct.'' Judicial Watch, a conservative group seeking the inquiry, said it will appeal to the U.S. Judicial Conference, the policymaking body for the federal judiciary. Bush," a faculty member at the State University of New York at Stony Brook, where the student-run newspaper is published, notified the Secret Service. The faculty member's concern about the safety of the president led to an interrogation of the author. The author was me. While the eloquence of my words is debatable-I wrote about the president's faith-based social-service plan-the legality of those words is not. And therein lies the problem. Paramount to our participation in the American system is the duty to exercise our freedom of speech. Unmitigated discourse-that never-ending debate that exists between ideological opposites-is the single most important factor in American life. Our ability to express ourselves as eloquently or as crassly as possible is what makes this society unique. Whether or not we agree with someone's viewpoints, we, as a society, agree with their right to speak them. He was a member of NationsBank's Board of Directors. His friend Hugh McColl was the chairman of NationsBank at that time. When NationsBank merged with Bank of America, McColl became chairman and CEO of Bank of America. McColl wrote a letter to Bill Clinton, recommending a pardon for Rick Hendrick -- and on December 7, 2000, Hugh McColl announced that Bank of America would donate $500,000 to the Clinton Foundation. Two weeks later, Hendrick would receive a Presidential Pardon. Bush belongs to one such family. In order to explain why, I need to use Bill Clinton as a counterpoint. For those of you who are tired of the latter's name, and who wish that we could all "just move on," I promise that my resort to the ex-president is not gratuitous. Before becoming president, Mr. Bush endured a gush of dismissive talk about being the privileged scion of a political dynasty. The boorish Maureen Dowd dubbed him "Little Bush," jeering repetitively about his "Poppy." Even his less intemperate critics drew attention to the undeniable advantage conferred on Mr. Bush by his situation as a past president's son. Those who favored him looked always to nudge the focus away from his heritage--his seigniory, if you like--and toward arguments and assertions that Mr. Bush was his own man, an independent and substantial entity, not a cipher grown large by virtue of his name alone. Even Mr. Bush recoils from his own privileged condition. This is to his credit, of course, proof of his dynastic fiber and propriety as well as of his undeniable modesty. During the campaign, his conscious folksiness, and the constant distancing of himself from "Washington"--a reference employed in his discourse, ironically, as a metaphor for Al Gore's privilege--showed how desperate he was to script a less obtrusive role for his father, and for things dynastic, than the one perceived by Ms. Dowd and her ilk. Mr. Bush was, in case the carpers didn't notice, constantly scaling Poppy back. And his father, than whom there are few men in America more gentlemanly, was entirely happy to have his scale reduced, aware always that, though he lost some lines in the script, his essential role was in no way diminished. Americans, I think, appreciate the understatement. Now for comparisons. Mr. Clinton, it is clear, is not from a political family. Unlike Mr. Bush, who is "in politics," Mr. Clinton is but a politician. This is an important distinction, indicative as much of form as of the deepest substance. When asked last week--in the wake of revelations that both Hugh Rodham and Roger Clinton had played inelegant roles in pardons granted by Mr. Clinton--whether he had any advice for his own family, Mr. Bush said, simply: "Behave yourself." These are words he need not have spoken, of course. There can be no doubt that a Bush, whether of this generation, or the last, or the next, or the one after that, will "behave" himself in a political milieu. Why? Some readers might find my use of the word "breeding" old-fashioned, but I fear there is no substitute. The Bushes have impeccable political breeding. Mr. Clinton has none. He is a political parvenu; a sparkling man, no doubt, and a man of vast intelligence, but he has no personal institutional memory. Consequently, his lack of respect for institutions--for his own office--came to be more pronounced. He wasn't to the manor born, so the manor became to him a source not of comfort, or of calm, or of a sense of service, but one of glee and fantasy and vainglory. And these sentiments--this unseemly sense of having "made it big," of having hit the jackpot--spread like a rash to his wife, to his siblings, to his wife's siblings, to his underlings, her underlings, their underlings. Mr. Bush, for all the dire warnings we were given about his intellect and about the irreparable harm of a court-ordered victory, has slipped so smoothly into his role as president as to suggest that high office runs in his blood. I detect, I think, the purr of an atavistic motor. I detect the workings of a man who is at peace with power, and with the stewardship of a nation. Mr. Bush is at ease at the pinnacle, just as he was at ease, earlier, with the inevitability of his rise. Contrast Mr. Bush's comfort in office with Mr. Clinton's luxuriation in it. This difference reveals the greatest paradox, as well as the greatest difference between the two men. Mr. Clinton, who took office the "hard way," had, from the start, a bursting sense of entitlement. From Mr. Bush's privilege, by contrast, flows a sense of sober authority, of a circumscribed trusteeship. Whom would you rather have as president? The privileged man, or the entitled one? The Quantity of Mercy A Los Angeles Times report floats a new explanation for Clinton's problem pardons: It seems the departing president was "driven to prove himself as compassionate as his predecessors." The paper reports: In the final months of his presidency, Clinton was open about his unhappiness with his clemency numbers. Stacked against the number of clemencies granted by Ronald Reagan and Jimmy Carter, Clinton felt his then-274 was far too low. He wanted to go out looking magnanimous, he told aides. . . . Until now, congressional leaders and other critics have suggested that influence peddling, campaign contributions and electoral politics are behind Clinton's pardon of fugitive commodities broker Marc Rich and some of the other 175 clemencies he granted on his last day in office. But former White House aides, Justice Department officials and others close to the process depict the controversial clemencies instead as the products of an overwhelmed and leaky system hobbled by human failure. We suppose this is intended to be a mitigating explanation. But is it really? It hardly speaks well of Clinton that he issued scores of pardons because he "wanted to go out looking magnanimous"--that is, that he used this solemn privilege as if it were a personal indulgence. Many of Clinton's abuses of power over the years have seemed more impulsive than calculating, but that doesn't make them any less abusive. Besides, the L.A. Times suggests a false dichotomy: Either Clinton was trying to boost his "clemency numbers" or he was peddling influence. There's no reason he couldn't have been doing both. And a New York Times report bolsters the view that he was: In interviews with more than a dozen lawyers this week, a common ingredient became evident in the final group of pardons: access, either to the president or to the White House counsel's office. Without such entree, it was nearly impossible to argue the merits of clemency applications, many lawyers said. Assistance was given by a wide array of people who topped the "Friends of Bill" list: Harry Thomason, the television producer; Terry McAuliffe, the longtime Clinton fund-raiser and recently elected Democratic National Committee chairman; the Rev. Jesse Jackson; and Harold M. Ickes, the former White House deputy chief of staff and senior adviser to Mrs. Clinton. The New York Times notes that at the request of that moral paragon the Rev. Jackson, Clinton commuted the sentence of one Dorothy Rivers, "a former official of the minister's Operation PUSH, serving six years for embezzling more than $1 million in federal aid for homeless children." A 1996 Justice Department press release announcing Rivers's indictment notes that she was accused of spending more than half a million stolen dollars "in a variety of ways, including lavish parties, expensive clothes, fur coats, and political campaign contributions, and she is charged with evading federal income taxes on the stolen funds." In an oddly Clintonian twist, Rivers entered what is called an "Alford plea"--that is, she proclaimed her innocence while acknowledging that the evidence was sufficient to convict her. Legally, this is tantamount to a guilty plea. Yet Another Unpardonable Pardon Writing in the Washington Post, former prosecutor Breckinridge Wilcox blasts Clinton for pardoning Samuel Loring Morrison, a former Navy intelligence analyst, who provided secret satellite photographs to a defense journal: In early August, Jane's Defence Weekly provided Morison a check for $300 for "editorial contributions for July 1984." . . . At the same time, Morison had been seeking employment at Jane's, and the day after he mailed the photographs, he wrote a Jane's editor asking to be remembered "when next year's budget is put together or when there is a vacancy." . . . Simply put, Morison was acting with the basest of motives--stealing classified information to curry favor with a potential employer. Clintonian Chutzpah The Weekly Standard's Christopher Caldwell deconstructs Clinton's two-faced explanation of the Marc Rich pardon. "There is something almost majestic about Clinton's gumption here," Caldwell writes. "He's trying to convince Jews that he'd gone through the political gauntlet of the Rich controversy only out of loyalty to them, while simultaneously convincing the rest of the country that he'd agreed to the pardons only because the Jews (or the Israelis) had him over a barrel." The Washington Post's Web site reproduces 21 of the letters Clinton received urging the Rich pardon, including those from Abe Foxman, head of the Anti-Defamation League, and various Israeli officials. What's more, Rodham's client made the donation on Nov. 27, 2000 - nearly a month after the election was over. Nora Lum and her husband Gene pleaded guilty to campaign finance violations in 1997 after making illegal donations to Massachusetts Senator Ted Kennedy. The Lums were also suspected of funneling thousands of dollars to the late Clinton Commerce Secretary Ron Brown, using his son Michael as a conduit. Mrs. Clinton's Senate campaign accepted the Lums' money despite their previous guilty plea. Though neither Lum received a pardon, the contribution raises questions about whether Hugh Rodham recommended that his clients donate to his sister's Senate campaign - as well as the donation's curious timing. The former president's least favorite staffers and appointees are spokesman George Stephanopoulos, FBI Director Louis Freeh, Attorney General Janet Reno and Labor Secretary Robert Reich, according to the March 5 issue of The New Yorker. The list comes from former Sen. Bob Kerrey, who told the magazine that Clinton mentioned the four -- plus a fifth person Kerrey couldn't remember -- when Kerrey and the former president had dinner Jan. 30 in New York. ''If Bill Clinton said it, I'm not surprised,'' said Reich, who now teaches at Brandeis University. ''I was an awful noodge. I made his life miserable.'' Reich headed the Labor Department during Clinton's first term and was considered a liberal voice in an administration that courted centrist voters. After leaving the administration, Reich accused Clinton of compromising too much and doing too little to solve problems like health care and the gap between rich and poor. Stephanopoulos left the White House in 1996 and became a commentator for ABC. He wrote a 1999 memoir about the ''Clinton roller coaster'' and was one of the first pundits to mention the word ''impeachment'' during the Monica Lewinsky scandal. As for Reno, the White House thought she ordered too many independent counsel investigations of top administration officials. And Freeh had repeatedly recommended an investigation of White House fund-raising. A spokesman for Stephanopoulos said he was traveling Monday and could not be reached for comment. Calls to Freeh, Reno and Clinton were not immediately returned. Kerrey left the Senate to become president of New School University. A spokeswoman said Monday he had no further comment. The California-based quarterly models itself on mainstream prestige magazines such as Harper's and the Atlantic Monthly. It offers educated Latino readers literary fiction, criticism, and news coverage by writers as distinguished as Nobel Prize winner Gabriel Garcia Marquez. Most strikingly, El Andar fearlessly prints muckraking investigations of the Mexican power elite. Julia Reynolds, El Andar's chief investigative reporter, remarked during an interview, "The movie 'Traffic' has suddenly made people want to read about Mexican corruption." Another factor drawing attention to Reynolds' articles (which are available online at ElAndar.com) is President George W. Bush's focus on Mexico. Last weekend, he made it his first visit to another nation since becoming president, and the creation of several commissions to consider cross-border issues is certain to keep it in the headlines during the rest of his presidency. Although a Feb. 13 Washington Post story claimed that President Bush's links to Mexico have been largely "ceremonial," El Andar has documented ties between the Bush family and a colorful cast of Mexican power-brokers going back four decades to an oil business partnership between George Bush and Jorge Diaz Serrano. The Bushes are of course a famously friendly family, with a huge circle of acquaintances. Several of their Mexican connections, however, have later caused them some embarrassment. For example, Diaz Serrano would go on to spend much of the 1980s in a Mexican prison for embezzling $58 million while he headed Mexico's Pemex oil monopoly. El Andar also reported that Florida Gov. Jeb Bush, the president's brother, occasionally vacationed at the Puebla ranch of Raul Salinas, the brother of former Mexican president Carlos Salinas (1988-1994). Raul can no longer host anyone, though. He is currently serving a 27-year prison sentence for the murder of his ex-brother-in-law. Raul's wife was arrested in Switzerland when she attempted to remove close to $100 million from their Swiss bank account. The Florida governor, whose wife Columba was born in Mexico, told Andres Oppenheimer of the Miami Herald, "I've seen [Raul Salinas] 10 times, at the most. I found him to be a very nice person, with very nice children . . . It's kind of shocking [to learn of] all these allegations." Jeb Bush said that he and Raul "never did any business." While El Andar's founder Jorge Chino is a Mexican immigrant, Reynolds is not Hispanic. She has, though, lived in Mexico and has worked in Latino journalism for most of her career. She got her start, however, working for the muckraking leftwing populist Jim Hightower. Many Latino-American publications try to show only the best sides of Latino culture. Yet, Reynolds claimed, "Our readers absolutely love muckraking about Mexico. The only ones who don't seem to like it are our targets." Indeed, one target, the family of Carlos Hank Gonzales, a powerful politician in Mexico's former ruling party (the PRI), has threatened to sue the tiny magazine for $10 million over Reynolds' article "The NAFTA Gang." According to Forbes Magazine, Carlos Hank Gonzales, a lifelong public servant, is a self-made billionaire. He justifies his good fortune with this elegant saying: "A politician who is poor is a poor politician." His son, Carlos Hank Rohn, is the primary shareholder in the $2 billion dollar Laredo National Bank of Texas. The controversial bank's CEO Gary G. Jacobs contributed a total of $85,000 to George W. Bush's two campaigns for governor, according to the campaign contribution database maintained by Texans for Public Justice. Jacobs has also contributed to numerous Democrats in recent years. A draft report leaked from the federal National Drug Intelligence Center (NDIC) alleged, "Several years of investigative information strongly support the conclusion that the Hank family has laundered money on a massive scale, assisted drug trafficking organizations in transporting drug shipments and engaged in large-scale public corruption." However, Clinton Attorney General Janet Reno later announced, "It was determined that the subject matter of the report was beyond the substantive expertise and area of responsibility for the NDIC, and the project was terminated." There has been little approbation and hardly any criticism from Congress. Most significantly, the new administration has not explained why it is violating Secretary of State Colin Powell's stricture that every U.S. military venture needs an endgame. The silence on the Potomac can be traced partly to a basic reticence by President Bush and his associates to share plans. But in this case, there appears to be no plan and no endgame. Diplomatic and intelligence sources indicate Bush was reacting to Saddam Hussein's heightened military activity, which in turn anticipated the change of government in Washington Jan. 20. Bush immediately called the Feb. 16 bombing a "routine mission." Indeed, the stepped- up bombardment signals no clear change from the Clinton administration's containment policy. The anti-Iraq coalition is no more, and Saddam has restored himself in the Arab world with stronger backing from Russia and China. At the time, the board had perpetrated firings and lockouts of key staff members, which disrupted programming at the station -- the Pacifica Network's flagship of progressive, community-oriented commentary -- but which also sparked a vigorous and sustained defense of the station by the community it serves. Happily, that community was successful in protecting KPFA's principled, alternative mission to provide an outlet for voices rarely heard in "mainstream" venues: voices primarily from the ground and from the left. In the meantime, however, Pacifica's east coast equivalent of KPFA, station WBAI in New York City, has come under a siege that mirrors the KPFA struggle to survive actions of a board bent on destructive change. Again, listeners dependent on the alternative sources of news, information and analyses available on a Pacifica station are alarmed and fearful that they are about to lose it all. Again, programming has been disrupted as beleaguered staff have been subjected to firings, lockouts and even "bannings." The firings, handed down without any semblance of due process so far as we can determine, include general station manager Valerie Van Isler, programming director Bernard White and Sharan Harper, former producer of the popular morning show, "Wake-Up Call." In addition, Amy Goodman and her nationally broadcast, award-winning bastion of uncompromising, incisive progressive commentary and analysis, "Democracy Now!", appear to be especially targeted -- although, as we write, Goodman and her show remain on course. Also ominous is the fact that the destabilization of WBAI is happening just as the FCC has severely restricted the public's ability to establish community programming outlets on the nation's airwaves. These new restrictions facilitate the further privatization of the means of political and cultural expression, consistent with a continuing nationwide assault on all things public. Undoubtedly, WBAI would benefit from managerial and professional "quality-control" adjustments designed to improve its operations. But any such changes must be made within the context of the station's founding mandate, and with respect for the rights of all staff to be treated fairly. The New York communities served by WBAI will not accept the dilution of the station's progressive voice, which seems to be the subtext of the Pacifica board's stated "audience expansion" objective. Nor can they accept the anti-democratic treatment meted out to union and management personnel alike by the Pacifica board and its agents. The Black Radical Congress demands, as steps toward resolving the current difficulties: (1) that terminated staff be reinstated, and that any issues concerning their job performance be addressed according to accepted due process procedures; (2) that the "bannings" and lockouts of certain staff members be lifted, and (3) that the concerns and expectations of the WBAI listenership be heeded and reflected in the process of settling the crisis. We strongly support the six dissident Pacifica National Board members who are working for a democratic and equitable solution to the crisis. Excellent review of the OKC bombing event. I too have always felt that the Murrah bombing was America's Reichstag, and Tim McVeigh was nothing but a government patsy. Steve -- WHO REALLY BLEW UP THE FEDERAL BUILDING IN OKLAHOMA CITY ? There is good evidence that the explosion that destroyed the federal building in Oklahoma could not have been done from the outside by a truck loaded with fertilizer!! According to Brigadier General Ben Partin, a demolition expert, and senior FBI agent Gunderson, the blast that killed so many people, including many innocent children, occurred on the inside of the building. The signature of the explosive was that of a barometric bomb that was timed to go off in at least three separate areas, one of which failed to explode. In addition, there had to be shaped charges at the bases of several [4-5] inside supporting pillars that allowed it to collapse and fall outward so that the front of the building was blown out into the street. This bomb is not available to the public and requires an expert to handle it, but the federal government has it. One of these failed to detonate and was found still attached to one of the inside pillars. The geology department at the University of Oklahoma recorded the blast on their seismographs. They reported to Agent Gunderson that two explosions occurred exactly 10 seconds apart. Now, one might wonder how all this could have been accomplished by Timothy McVeigh? Using a truck parked in front of the building and loaded with ammonium nitrate? Not likely! What is apparent is that the concussion of the truck bomb set off the barometric bombs inside the building. The major part of the damage occurred when the building was blown outward from an explosion within. There was not even a crater caused by the truck explosion. So, who could have done it, and why? The federal government has the means, an no one else does, unless the bombs were stolen. It may be significant that, by a strange coincidence, all of the offices, including all the files of the FBI, the ATF, the EPA, and the IRS were moved out the night before as testified by members of the maintenance crew who assisted in the move. Regrettably, one secret service man wasn't told, and he was killed in the blast. But, why would federal agents do such a terrible thing? Did these people want to be able to put the blame on radical militia members? Did they want to discredit the "radical right" and create the impression that there was some sort of terrorism going on, perpetrated by people who were opposed to the government? Do they want more power over the citizenry? Why do the media continue to lie about the tragedy? Is it because the powerful Insiders wanted the antiterrorism bill passed in Congress? If the BATF is innocent, why did they immediately bury the debris from the building so that most of the clues would be unavailable? Perhaps they remembered the clever ploy of Adolph Hitler, who was elected Chancellor of Germany in 1933. It is documented that Hitler burned the Reichstag Building in Berlin and then blamed it on "subversives." A known communist was executed for the crime, and Hitler persuaded the Parliament to give him dictatorial powers in order to combat the "terrorist threat." The civil rights of the German people were no longer in effect. You recall what happened in Europe, after that It is noteworthy that Clinton's antiterrorist legislation was floundering in the U.S. Congress, but was quickly passed by the befuddled Congress just after the destruction of the Murrah Building.. Will there be more acts of "terrorism" in order to try to convince the people that such legislation is absolutely necessary, so that Congress will be pressured to pass more such bills in the guise of protecting our women and children from terrorism? What about the railroad accident in Arizona? Was it really caused by a group called "The Sons of the Gestapo?" There is no evidence that this group exists. Or was it an act of "Agents Provocateurs"--certain agents of the BATF, FBI, ISA, or the IRS? Now that this legislation (the Antiterrorist bill) has been passed, essentially all of our protections under the ten amendments to our Constitution ( the Bill of Rights ) can and would be suspended, if the President declares a national emergency. Congress would probably be permantly adjourned. The state and local police would be completely federalized. Habeus Corpus and posse commitatus would be suspended. Federal agents are now free to tap your telephone, seize your property, break down your door at 2 AM and arrest you, beat you to unconsciousness, seize your weapons, and imprison you or kill you with impunity. The US aid package of $1.3bn was voted through Congress on the guarantee that US personnel would not get directly involved in the fighting. The aid package is ostensibly for the war against drugs but since guerrillas and right-wing paramilitaries are deeply involved in the narcotics trade, the drug war is synonymous with the civil conflict. Another Vietnam This latest fighting over the weekend saw Americans paid by the US flying helicopter gunships that were used to put suppressing fire down on guerrillas whilst grounded crewmen were rescued. The Farc have vowed to turn Colombia into another Vietnam for the US and have stated that all American military personnel in the country are considered targets. Guerrilla sources have said they cannot see the difference between US service personnel and Americans in the pay of the US government. They say that the United States has crossed the line and is intervening in the 37-year civil conflict. Scientists say that channels on Mars's surface may have been carved by flowing water and an ancient ocean may have existed there, but little is known about the source of the water. One possible source is volcanic degassing, in which water vapor is produced by magma spewing from volcanos, but the Martian rocks that have reached Earth as meteorites have notoriously low water content. This study shows that before the molten rock that crystallized to form Martian meteorites was erupted on the surface of the planet, it contained as much as 2 percent dissolved water. When magma reaches the planet's surface, the solubility of water in the molten liquid decreases and the water forms vapor bubbles and escapes as gas. The process is similar to the release of gas bubbles that occurs when you open a can of soda. Although this doesn't explain how water got into Mars in the first place, it does show that water on the red planet once cycled through the deep interior as well as existed on the surface, as similar processes have cycled water through the Earth's interior throughout geologic history. A VISITOR FROM MARS Timothy L. Grove, professor of Earth, Atmospheric and Planetary Sciences at MIT, and University of Tennessee geologist Harry Y. McSween Jr. analyzed the Mars meteorite Shergotty to provide an estimate of the water that was present in Mars magmas prior to their eruption on the surface. Shergotty, a meteorite weighing around 5 kilograms was discovered in India in 1865. It is one of a handful of proven Mars meteorites that landed on Earth. It is relatively young -- around 175 million years old -- and may have originated in the volcanic Tharsis region of the red planet. Its measured water content is only around 130-350 parts per million. But by exploring the amount of water that would be necessary for its pyroxenes -- its earliest crystallizing minerals -- to form, the researchers have determined that at one time, Shergotty magma contained around 2 percent water. They also have detected the presence of elements that indicate the growth of the pyroxenes at high water contents. This has important implications for the origin of the water that was present on the surface of the planet during the past. This new information points to erupting volcanos as a possible mechanism for getting water to Mars's surface. SQUEEZING HYDROGEN INTO ROCKS In the interior of Mars, hot magma is generated at great depth. It then ascends into the shallower, colder outer portions of the Martian interior, where it encounters cooler rock that contains hydrogen-bearing minerals. These minerals decompose when heated by the magma and the hydrogen is released and dissolves in the magma. The magma continues its ascent to the surface of the planet. When it reaches very shallow, near-surface conditions in the crust, the magma erupts and its water is released in the form of vapor. The magma holds the water-creating hydrogen as the rock circulates underneath the crust. It undergoes changes as it moves from areas of enormous heat and pressure to cooler areas nearer the surface. When it finally erupts through a volcano, the magma releases its water in the form of vapor. Grove recreates Mars and moon rocks in his laboratory for these studies. By subjecting synthetic rocks to conditions of high temperature and pressure, he can tell how much water was contained in magma at the time that its crystals were formed. "What my experiment can do is estimate how much water was involved in the process that led to the formation of Mars meteorites. The only way you can reproduce the unique chemical composition of these minerals is to have water present," he said. Other authors on the Nature paper include McSween's graduate student, Rachel C. F. Lentz; Lee R. Riciputi of the chemical and analytical sciences division of Oak Ridge National Laboratory; Jeffrey G. Ryan, a geologist at the University of South Florida; and Jesse C. Predator missile launch test totally successful by Sue Baker Aeronautical Systems Center Public Affairs WRIGHT-PATTERSON AIR FORCE BASE, Ohio, (AFPN) -- Aerospace history was made recently with the successful launch of a live missile from an unmanned aerial vehicle. The Air Force's Predator Unmanned Aerial Vehicle program is evolving from a non lethal, reconnaissance asset, to an armed, highly accurate tank-killer, according to senior program officials from Air Combat Command at Langley Air Force Base, Va., and Aeronautical Systems Center here. "Capping a three-part series of demonstration flight tests on Feb. 21, Predator successfully aimed and launched a 'live' Hellfire-C, laser-guided missile that struck an unmanned, stationary Army tank on the ground at Indian Springs Air Force Auxiliary Airfield near Nellis AFB, Nev.," said Major Ray Pry, Predator program manager. Flown by a pilot and sensor-operator from the 53rd Test and Evaluation Group at Nellis, who were located in a nearby Ground Control Station, Predator launched the missile using line-of-sight communication, inflicting heavy damage to the tank," Pry said. The final flight, part of the Phase I feasibility demonstration that began in August, was preceded by two similar, completely successful Hellfire launches, Pry said. "This first recorded missile launch from a UAV took place on Feb. 16," he said. "Equipped with a single, inert Hellfire-C missile, the Predator, using its line-of-sight communication band and infrared 'Kosovo' laser-ball, aimed and struck the tank-turret about 6 inches to the right of dead-center, spinning the turret around about 30 degrees. It made a big, gray dent in the turret -- just beautiful." Following that first launch, the Predator/Hellfire launch team reviewed telemetry data and camera footage captured by the GCS crew and a helicopter from the Nellis Range, Pry said. "We wanted to be sure that we had captured what we thought we had seen -- that the stress and loads were within Predator's limits, and that the guides worked perfectly," he said. "With two shots planned for Feb. 21 using both satellite and LOS communications links, we wanted to ensure we could use the satellite link to fire the missile." With the initial weaponization feasibility tests successfully completed, Gen. John Jumper, Air Combat Command commander will review the results to determine when Phase II will begin, said Lt. Col. Tom Carlson, director of ACC's advanced weapons requirements branch. "Phase II will take the Predator/Hellfire combination to more realistic, operational altitudes and conditions, including the challenge of a moving target," Carlson said. "This will complete the demonstration of the objectives we set down at the beginning of this process, to demo the technology, and prove its operational feasibility." There are still some challenges ahead, the colonel said. "We need to do some re-engineering on the missile, to take it up to higher altitudes. Once we're given the 'green light' to proceed to Phase II -- and all indications are that we will - it will require another symphony of players, brought together by Major Pry and his team, to execute the second round of demonstration flights. "The bottom line is that we are taking a Hellfire missile, normally launched from an Army helicopter with its landing-skids 'in the trees,' or from the deck of a sea-borne Navy carrier, flying under 2,000 feet, and asking it to fly at higher altitudes," Carlson said. Air Force releasing senior master sergeant promotion list March 7 RANDOLPH AIR FORCE BASE, Texas (AFPN) -- The Air Force plans to release its list of the newest senior master sergeant selectees March 7. Beginning April 1 and over the course of the next year, 1,354 individuals out of 16,203 eligibles will sew on their new stripes. This represents a selection rate of 8.36 percent, an increase from last year's promotion rate of 7.89 percent. Over the past few years, senior master sergeant promotion rates have improved when compared to percentages in the early to mid 1990's, said Air Force personnel officials. For example, 1994's selection rate was just 4.62 percent. The cycle 01E8 Senior Master Sergeant Evaluation Board convened Feb. 5 to 23 at the AFPC here, to evaluate individual records of senior master sergeants eligible for promotion. The average total score of selectees during the cycle was 671.68. Pulling it out of the sheep dip was an international triumph." A note from a reader down under: Hi Keith, Hope things are going well. I'm not sure if you are aware of a film that is about to be released in the United States known as The Dish. It is a movie that was made here in Australia, and is based upon how the pictures of Apollo 11's moonwalk was received by the radio telescope built in Parkes, New South Wales. The film is a comedy that sees how three local scientists, and a NASA engineer have to cope with problems in getting the first live pictures broadcast to the worldproblems such as power outages, loss of computer information and high winds that threaten to collaspe the enourmous Dish. When the film opened here in Australia, it broke all box office records, and became one of the most popular is our history of Motion Picture Arts. I am a huge fan of the film (I saw it 5 times), because of its accuracy, comedy and direction in giving the viewer a feel of the extraordinary event that took place in July 1969. It opens in the US on March 14th (Nationwide on April 25th), and I am eagerly awaiting to find out what the reaction will be from the US. How exciting it was? What if you had actually been involved in it? Introducing "The Dish", a movie about a handful of people working at the town of Parkes and in the giant radio telescope nearby, covering from July 16th 1969 to the 22nd. A drama-comedy: equal parts of "Crocodile Dundee" and "Apollo 13", if you will, with an added touch of romance that is full of charm. Since this is a film about the past, there are few surprises. The three Australian scientists in charge of the dish (and one NASA rep.) suddenly find themselves thrust into an essential role in the Apollo mission, while in the town the citizens from the mayor down host (somewhat anxiously, on occasion) a variety of celebrities there for the occasion. The episode of the 60 mph winds on the day of the big event is also a historical fact. No effort has been spared for realism. Apparently much of the equipment shown is the original comms. gear installed by NASA for the occasion. The actors are reasonably famous in Australia but I suspect unknown in the USA, except possibly for Sam Neill and Bud Tingwell. The beauty of the rural countryside in the area is very accurately depicted. Having been in Parkes many, many times; and recently, the whole movie was to me a very nostalgic experience. One thing about some Australian movies, especially comedies, has concerned me in the past, and that is that often the "Australianisms" are greatly exaggerated. Not every Australian speaks like "Crocodile Dundee", anymore than every American black speaks like say Eddy Murphy or Chris Tucker. Fortunately this movie maintains a good grip on reality in this regard. Some of you may have read my rave reviews of a cult Australian comedy "The Castle", which became the second highest TV rating movie ever in this country (beaten only by "Sound of Music"). "The Dish" is made by the same production company and is of a similar standard. In Australia, at least, so far it looks to be heading for similar success. Certainly a movie that I will see again. Bush really won Florida. Yes, this is the same Miami Herald that a few months ago predicted when the independent recount it had undertaken was completed that Al Gore would be at least 23,000 votes ahead of Bush. Gosh, we are not supposed to remember such things. In a move reminiscent of the late Rosemary Woods' explanation of how she made gone with 18 minutes of the infamous Watergate tape, Herald reporter Amy Driscoll, without even mentioning the paper's prediction based on its earlier findings, much less taking into consideration the Gore votes Florida Secretary of State Katherine Harris refused to accept and a heap of other shenanigans, has decreed that "Al Gore would have netted no more than 49 votes if a manual recount of Miami-Dade's ballots had been completed, according to the review, which was sponsored by The Herald and its parent company, Knight Ridder. That would have been 140 too few to overcome Bush's lead, even when joined with Gore gains in Volusia, Palm Beach and Broward counties-the three other counties where Gore had requested manual recounts." To muddy the waters more and give further impetus to the rabid Bush supporters, whose mantra is, "We won. You lost. Get used to it"-kind of makes you want to add, "Cha, cha, cha"-the headline and subhead on Driscoll's story were: DADE UNDERVOTES SUPPORT BUSH WIN Review of ballots by Herald suggests Gore recount effort would have failed Neat, eh? Perhaps we should start a Rosemary Woods Award. Surely, Driscoll and Harris would be two of the nominees. In a letter he fired off to the Herald, Michael Rectenwald, chairman of Citizens For Legitimate Government http://www.legitgov.org, wrote: "Firstly, The FL Supreme Court ordered the whole state recounted. But, even based on the recounts that have already been done, Gore wins Florida. The Herald's piece discounts the votes already manually recounted but disallowed by Harris (ironically totaling some 140). The piece discounts the fact that one county reverted back to a their first count and thus cost Gore votes. The story completely ignores the Palm Beach Post article that analyzes the undervotes in that county that alone give Gore the lead (http://www.gopbi.com/partners/pbpost/news/election2000_pbgore.html, and instead cites an earlier, superseded article. It disregards the Washington Post article that analyzes over-votes and that shows the thousands of votes lost where the intent off the voters is easily discerned (http://www.washingtonpost.com/wp-dyn/articles/A53804-2001Jan26.html)." Rectenwald went on to jog Driscoll's memory about the voter purge scandal, which only ace reporter Gregory Palast and the British media seem interested in. "This purge alone cost Gore the election, and it was illegal and carried out by Katherine Harris with the explicit knowledge of Jeb Bush. This alone is a scandal that should reach the proportions of a Watergate, but given the rightwing control of the media, may not reach the light of day in the U.S.A. But Driscoll would undoubtedly reject that argument, because purged voters cast no ballots; neither did thousands of African-American voters still on the rolls, but who were robbed of their votes by a variety of tactics. "This Herald article is another attempt by the G.O.P.'s organs to bestow legitimacy upon a fraudulent mis-ministration; it is a very shoddy piece of 'journalism' in that it is utterly incomplete, utterly irresponsible to the whole story, and obviously a piece of G.O.P.-sponsored propaganda. Congratulations, you have sunk to yet new lows," Rectenwald said. But this is only one of the "new lows." The rabid Reich has a two-fold goal in mind for its latest round of trumped up Clinton scandals: 1) Neuter the Big Dog, who is the Democrats greatest fund raiser and 2) Destroy the Democratic Party in the process. The chilling part is that the Democrats in Washington are trotting like cattle to the slaughter. As if these things were not enough, the Landmark Legal Foundation wants the Internal Revenue Service to investigate whether any liberal nonprofit organizations violated their 501(c)(3) tax exemption by opposing the confirmation of John Ashcroft as attorney general. Landmark received funding from several Scaife family foundations, the John M. Former President Clinton's Presidential Library Fund has sent a letter to Burton's Committee saying the Fund will allow Congressmen Burton, R-Ind., and Henry Waxman, D-Calif., to review a list of donors who have contributed $5,000 or more. Last week, the committee was rebuffed in its request to review the foundation's donor list. The committee wants to see if any money came in that could have been promised in exchange for pardons. Meanwhile, it was revealed late Monday night that Secret Service records show Denise Rich and former Democratic Party Finance Chairwoman Dozoretz visited the White House on President Clinton's last night in office, when he was deciding on the pardon of Marc Rich and others, a Congressional source tells FOX News. The records show Dozoretz logging in at the White House at 5:29 p.m. and Rich logging in at 5:30 p.m. on January 19. But Dozoretz's husband, Ronald Dozoretz, told Fox News that although his wife was cleared to enter the White House, she was on a plane in California with him at 5:30 p.m. on Jan. 19, one minute after Secret Service logs show she entered the White House complex. Dozoritz said he, his wife and his boss were all on a flight together at that time to Los Angeles for a business meeting and later a party. And a source close to Denise Rich also claims Rich was not at the White House that night. The source told the Washington Post that Denise Rich said she was invited to the White House but did not go. Congressional sources told Fox News they cannot explain why White House logs indicate Rich and Dozeretz were at the White House Jan. 19 when family, friends and other witnesses maintain the two women were elsewhere. The sources said the discrepancy may be due to record-keeping errors made by the Secret Service. The Secret Service logs obtained by the House Government Reform Committee show that between 1994 and Inauguration Day â Jan. 20 â Denise Rich was scheduled to arrive at the White House 19 times, but only actually logged in 13 times. Between 1999 and Inauguration Day, Dozoretz visited the White House 43 times. Taking the Fifth Earlier Monday, Dozoretz invoked her Fifth Amendment protection against self-incrimination and refused to testify before the House committee probe into Clinton's pardon of Marc Rich. Committee Chairman Dan Burton, R-Ind., has scheduled a hearing for Thursday to investigate the Clinton pardons, and Dozoretz is on the witness list. Uranium scare worries NATO Alliance's unity at risk, internal document warns Mike Blanchfield The Ottawa Citizen NATO officials are concerned that "a legacy of doubt" could weaken the alliance if it does not properly address the controversy over whether depleted uranium poses a cancer risk to its troops. The North Atlantic Treaty Organization fears some of its 19 member countries might opt out of military missions if depleted uranium is, or has been, used in proposed areas of operation. "This could have profound impacts on future coalition operations and Alliance cohesion," warns a NATO briefing document recently tabled at the alliance's Brussels headquarters, a copy of which was obtained by the Citizen. The document, intended primarily for the eyes of NATO member countries, summarizes the controversy that flared in Europe last month over depleted uranium, and whether it is responsible for "Balkans Syndrome," a label that has been given to unexplained deaths and illness among some alliance troops. The leukemia deaths of about 20 peacekeepers from Italy, Germany, Portugal, Spain and elsewhere raised concerns about whether the 40,000 anti-tank missiles used during the Kosovo and Bosnia bombing campaigns might be posing a health risk. The weapons were tipped with radioactive depleted uranium. Since the flare-up of the controversy, NATO health officials have presented a calm and confident public response. At two Brussels press briefings they restated the fact that there is no proven scientific link between exposure to depleted uranium and increased cancer rates, but added that because of the concerns raised, the alliance favours further studies of the issue. While NATO might have science on its side, the internal document expresses concern that political fallout in some countries over the depleted uranium scare could undermine the strength and solidarity of the alliance. "Public opinion in many European nations is already skeptical about official advice on health issues following a history of confusion and U-turns on BSE or 'mad cow disease,' " the document says. "No matter what the scientific evidence, it is possible that the current debate over depleted uranium munitions will leave a legacy of doubt and suspicion such that certain NATO allies might be unwilling to become involved in operations -- or the aftermath of operations -- where depleted uranium munitions are used." The document concludes that the level of radiation emitted by depleted uranium is too low to cause cancer and that it is "unlikely to be a source of a 'Balkans Syndrome.' " It recommends that a special NATO committee, recently formed to address the issue, ensure that the results of further studies are rapidly disseminated. "It might well be the case that the committee's mandate should be broadened if studies indicate the presence of a health hazard but exonerate depleted uranium." The committee includes representatives from 50 countries and five international organizations. The report also says NATO should adopt a suggestion by the World Health Organization that calls for cleaning up or cordoning off heavily bombed areas to minimize radiation exposure. Since depleted uranium re-emerged as a political issue in Europe last month, the European Parliament passed a resolution calling for a ban on the substance. The United Nations Environment Program is gathering data on the radiation levels at bomb sites in the Balkans and is to report its findings in a matter of weeks. Canada has said that voluntary testing of its peacekeepers has shown no elevated levels of cancer. Foreign Affairs Minister John Manley is in Brussels today for informal meetings with his NATO counterparts. Farms: from crisis to epidemic Fordyce Maxwell, Farming Editor A further five cases of foot-and-mouth disease were confirmed yesterday , taking the total to 12 and involving 7,000 animals in Britainâs worst outbreak since 1967 as experts said the crisis was increasingly likely to become an epidemic. Two cases were confirmed in Devon and one in Wiltshire, all linked conclusively to the Devon outbreak confirmed on Sunday. Other cases were at Westerhope, Northumberland, linked to the Heddon-on-the-Wall pig farm still suspected by Ministry of Agriculture vets as the original source of infection, and at a farm in Hereford. Last night, ministry vets were investigating Nether Place Farm, Lockerbie, Dumfries-shire, and still carrying out tests at farm near Bowsden, Northumberland, only a few miles from the Border. The result of tests on pigs at Banks Farm, Fyvie, Aberdeenshire, are expected today . The expert view that cold weather and snow might encourage, rather than kill, the virus which is a particularly virulent strain , was heeded by Scottish Borders Council which announced that it would restrict road clearing operations and keep rural services, such as rubbish collection vehicles, away from the hundreds of farms in its area. The list of new cases - with 1,800 cattle, 1,600 pigs and 3,500 sheep now either slaughtered or about to be slaughtered - grew longer as Prime Minister Tony Blair vowed that government would take every necessary step to fight the outbreak. He said: "It is extremely serious. There is no doubt at all that there will be huge anxiety amongst farmers the length and breadth of the country." He added: "We have simply got to wait and see how widespread this disease is. Whatever is needed to tackle and eradicate it, those steps we will take." Nick Brown, minister of agriculture, in a statement to the Commons said: "The government is determined to eliminate the disease." He emphasised again that there was no threat to human health or food safety and that there was no threat of disruption to food supplies in spite of the seven-day restriction on all livestock movement in Britain, except poultry and milk supplies. He urged the public to co-operate in helping avoid any risk of spreading the disease by staying away from the countryside, particularly livestock areas, but hinted that could be backed by temporary closure of rights of way and footpaths. He will brief other European Union farm ministers on the outbreak this morning . Yesterday in spite of praise from some EU ministers for Britainâs handling of the crisis, Germany and Holland were slaughtering stock where there was any hint of contact with Britain. The standing veterinary committee of the EU will discuss the outbreak today. Ross Finnie, rural development minister, said that the Scottish executive, would maintain movement restrictions because the disease did not recognise national borders. He added: "There are still no confirmed cases in Scotland. But we must remain greatly concerned and we will maintain our tough controls." Much of Britainâs rural community is now under siege with children kept away from school and many families are confined on farms under exclusion orders as investigations are carried out. The massive Countryside Alliance march planned for London next month has been cancelled and international rugby matches are under threat. Supreme Court Weighs Rights of Landowners Tuesday, February 27, 2001 E-mail This Story WASHINGTON -- In a case that could have broad implications for environmental and regulatory policies, lawyers argued before the Supreme Court Monday about whether governments are unconstitutionally "taking" someone's property when they pass regulations that effectively lower its value. Lawyers for Rhode Island plaintiff Anthony Palazzolo argued that the state, which has for 20 years prevented him from developing a pond-side plot of land because it is protected wetlands, should pay the retired auto wrecker because its value is diminished by the regulation. "Declaring something an environmental issue is a way for the government to effectively deprive the owner the use of the property without paying the price for it," said R.S. Radford, an attorney for the Pacific Legal Foundation, a property rights law firm representing Palazzolo in the case. "The outcome of this case could have broad implications for the protection of our coastal ecology and our nation's environment in general," said Rhode Island Attorney General Sheldon Whitehouse, who argued the state's case before the high court. Whitehouse argued that Palazzolo was not, in fact, totally deprived of his property. "There is value in this property," he said, because a home could be built on the higher-ground area of the land. If Palazzolo prevails, governments could be forced to rethink the way they issue regulations that impact the value of private property, including monumental laws such as the Endangered Species Act and clean air and water rules. Palazzolo bought the land in 1959 as an investment, intending to develop it piecemeal over the years. The 18-acre parcel was zoned for residences or a beach club and Palazzolo planned to fill in the marshy lots and sell them to make some money on the side. "I'm not a developer," the 80-year-old Palazzolo said. "All I wanted to do was improve my land and sell the lots occasionally as I went along." A series of environmental restrictions enacted in 1971 and 1977 made his plans impossible, though. He later sued the state for $3.15 million in lost value. His attorneys argued that the government in essence "took" the land from him by blocking his proposals, violating the Fifth Amendment clause that states if a government takes a person's property, it must pay just compensation. "If we look at the history of environmental regulations in this country, especially in the last 10 or 12 years, it has been proceeding on the assumption that the government can deprive owners of the rights of their property at the stroke of a pen," Radford said. The case is being closely watched by organizations on both sides of the property-rights debate. Among those supporting Palazzo are Defenders of Property Rights, the National Association of Home Builders and the American Farm Bureau Federation. -Caveat Lector- February 27, 2001 Press Blows Florida - Again http://www.consortiumnews.com/022701a.html Americans who watched the news media rush to judgment on Election Night, first awarding Florida to Al Gore and then giving it to George W. Bush and then settling on "too close to call"might have thought the national press corps had learned its lesson. You might have thought that major news organizations would at least wait for the final tallies in the unofficial recounts now underway before calling a winner. If you had that expectation, you'd be disappointed again. The latest bizarre example of the news media's compulsive rush to judgment has come in the handling of a Miami Herald/USA Today report about an unofficial tally of Miami-Dade "undervotes," ballots that were rejected by counting machines as registering no choice for president. The latest facts were these: After examining Miami-Dade's 10,646 undervotes, out of about 60,000 statewide, this unofficial tally found Gore closing to within about 140 votes of Bush. In other words with nearly 50,000 undervotes still to be examined, only about 140 votes separated the two candidates. Those who have been following the work of other Florida news organizations in other counties also would know that hundreds of uncounted votes clearly intended for Gore or Bush had been discovered over the past two months, both in "undervotes" and in "overvotes" in which voters had marked their ballot for a candidate and then written in the candidate's name. From these other unofficial tallies, Gore had made surprising net gains in some counties that had favored Bush overall. By some counts, Gore even had pulled ahead of Bush, though clearly the outcome of these unofficial tallies remained in doubt. Once all the counting was over, it seemed plausible that either Bush might hold on to a narrow lead or that Gore might inch ahead. Either result, of course, would not change the fact that Bush had been awarded Florida's 25 electoral votes and had become the first national popular-vote loser in more than a century to claim the White House. Nor would the unofficial tallies change the reality that Gore almost certainly was the choice of a plurality of Floridians, if not for the confusing ballot in Palm Beach County, which apparently caused thousands of elderly Jews to vote for Pat Buchanan, and the state's alleged purging of thousands of African-Americans from the rolls on the grounds that their names were similar to those of convicted felons. The unofficial newspaper tallies were intended only as an historical marker. So why the rush? Wouldn't it make sense to wait until the statewide tallies were complete so as not to sow any more confusion and distrust? At minimum, wouldn't it be reasonable to make clear how limited any new partial tally was? Not in the Cards That apparently is not how the American news media works anymore. The big-name news organizations seemed to have learned nothing from Election Night. Rather than cautious, balanced stories about the limits of the new Miami-Dade tabulation, the news media rushed to declare Bush the legitimate winner in Florida and thus of the presidency. "If a manual recount of presidential ballots had gone forward in Miami-Dade County, George W. Bush likely would have won the presidency outright," wrote the Miami Herald. [Feb. 26, 2001] "Review Finds Bush Won Despite Miami Recount," declared a headline in The Washington Post. "A review of Florida ballots suggested Gore wouldn't have gained enough in a recount to win the presidency, the Miami Herald said,'' summarized the Wall Street Journal. By Monday evening on television, the limited findings of the Miami Herald had been transformed into the final word that Bush really did win the election. Without doubt, millions of Americans who still have faith in the national news media will go away with that impression. Yet, besides exaggerating the conclusions, the articles were misleading in another way. They suggested that the only recounts that mattered were the ones in South Florida where the Gore campaign first raised questions about the results. The hook for the Miami Herald story really was that if Bush and his campaign had not frustrated those early recounts, they still would have been slightly ahead. But the decisive recount issue was not the count in South Florida. It was Bush's success in having his five conservative allies on the U.S. Supreme Court overturn a ruling by the Florida Supreme Court that had mandated a statewide recount of the so-called undervotes. That recount of 69 Florida counties was underway on Dec. 9 when the five conservative justices in Washington took the unprecedented step of halting the counting of votes in a U.S. presidential election. Then, on Dec. 12, they prevented a resumption of the recount, effectively handing the presidency to Bush. The Bank of England declined to comment on speculation that it had been forced to borrow back gold after overexposing itself on the lending market. Analyst Andy Smith of Mitsui said, "The only fact we have is that gold lending rates went up to 4 percent this morning, from 1 percent yesterday, so the lease market is tighter -- then we have the embroidery." Late on Tuesday one-month lease rates were indicated at 3.93 percent, up from 1 percent at the end of last week. "There is less gold around to borrow because there is less supply of gold lent into the market, because maybe a few central banks have taken gold back because they believed the lease rates were too low," Smith said. Central banks are holders of large quantities of gold and frequently lend part of their reserves to the market in exchange for dollars, which usually offer more attractive yearly returns. In September 1999 gold lease rates rocketed to 10 percent in the wake of the Washington Agreement, which was ratified by 15 European central banks -- including the Bank of England -- to limit their gold sales and lending for a five-year period. The deal was signed just as the price was staggering to recover from 20-year lows at $255 a troy ounce reached the previous month. Some traders said that one explanation for the higher rates could be that a group of central banks was tightening the screws on the lease market ahead of a decision to scale back their lending. Others were less convinced that the sudden changes in the rates had anything to do with the Washington Agreement signatories. "This could not have been any of the banks in the Washington Agreement. None of them would break it at this stage," said one dealer. Another trader said the Bank of England was an unlikely suspect, and that the activity could well stem from a central bank outside the Washington Agreement. "There is still plenty of gold available in central banks that do not belong to the agreement, like the South Americans, even if it is not in the same quantities as the Europeans," he said. In any case, most believed that tightness would be short-lived, and would not translate necessarily into higher spot prices over the longer term. "The market is still relatively tight, but people are having no trouble getting hold of it. But of course they have to pay the price for that," said one European trader. "The gold market is a small village, and a little bit of gossip spreads like wildfire," Mitsui's Smith said, adding that he expected lease rates to ease very quickly. The World Gold Council (WGC), a London-based lobby group representing the gold industry, was more positive. In its weekly report published on Tuesday, the WGC said traders holding gold were able to command higher prices from those needing liquidity. "Under these circumstances the cost of holding short positions is becoming increasingly expensive, and with gold prices rising in the wake of higher lease rates, this could trigger some significant short covering," said WGC head George Milling-Stanley. Luckily, no one died from eating it. But what if someone had? by Brian 0'Reilly For anyone in the business of growing corn, one of the biggest frustrations of the job is a brown inchworm-like creature that spends most of the summer and fall munching and tunneling through the corn, only to emerge as a moth that flies off to spawn a lot more inchworms. Like many adolescents, corn borers can be enormously destructive. Depending on when in the growing season they arrive, they can damage arteries that carry moisture to corn, or even cause the entire ear to fall off before harvest. The borer costs American farmers and their $20 billion corn crop upwards of $1 billion a year, if you count diminished yields plus the price of pesticides and other measures needed to keep the borer at bay. So in 1995, when scientists produced an early variety of genetically modified corn that poisoned the borer shortly after its first cornstalk casserole, farmers fairly jumped for joy. But last summer, right in the middle of the harvest, things got messy. Plant Genetics Systems, a company now owned by Aventis, a giant European pharmaceuticals firm, had developed another borer-killing gene that it called Starlink. However, the toxin that Starlink produced in the corn plant resembled a substance that triggers violent allergies in some people. When federal regulators threatened to ban Starlink corn until its safety in humans could be established, the developers thought they had a better idea. In effect, they promised to sell Starlink seed only to farmers using it for feed corn; in turn, the farmers would agree not to sell the seed to anyone who would put it in human food. Okay, said the feds. But be careful. Well, guess what? Almost everybody involved screwed up. Even though Starlink was on the market for just three years-and made up just 0.5% of the 80 million acres of corn planted in the U.S. last year-it began showing up in all sorts of places it didn't belong, including tacos, corn chips, breweries, and muffin mix. The promises made by Starlink's inventors proved worthless, falling prey to managerial inattention, corporate mergers, blind faith, misplaced hope, woeful ignorance, political activism, and probably greedy farmers too, if you can imagine such a thing. Any batch of core destined for human consumption must now be ground up and tested for the StarLink gene. The episode hardly qualifies as a disaster, since no one seems to have gotten seriously ill from eating Starlink corn. Howard Buffett, son of Warren and a farmer near Decatur, Ill., even sees a bright side to it; he says Starlink has revealed the shortcomings of federal oversight and has pointed up the inability of the grain-handling industry to segregate subtly different products. Bush would have won the presidency outright without weeks of indecision. The newspaper reported Monday that Al Gore would have netted no more than 49 votes in Miami-Dade, 140 shy of the total needed to overtake Bush even when combined with Gore gains in the three other counties where the then-vice president had requested manual recounts. "President Bush was lawfully elected on Election Day. He won after the first statewide machine recount," said Mark Wallace, a Miami lawyer for the Republican Party. "He won after the manual recount, and he won at the conclusion of all the litigation. "Now, after a ballot review using liberal standards unprecedented under the law, we find President Bush would still win. At some point, the Democratic National Committee needs to accept that, and that time is now," Wallace told the newspaper. But some Democrats insisted The Herald's review shows that neither side could have known how the recounts would turn out. "This underscores how unpredictable the whole recount strategy was, on both sides," said Doug Hattaway, former Gore campaign spokesman. "This shows bush's tactics of delaying and blocking vote recounts didn't really benefit him." The review - which was sponsored by The Herald and its parent company, Knight Ridder - found that 1,555 Miami-Dade ballots were marked in a way that might be interpreted as a vote for Gore. An additional 1,506 bore some kind of marking that might be interpreted as a vote for Bush. There were 106 markings for other candidates. No markings for president were found on 4,892 ballots, and 2,058 ballots bore markings in spaces that had been assigned to no candidate. An additional 527 ballots were deemed to have markings for more than one presidential candidate. Gore had requested manual recounts in Miami-Dade, Broward, Palm Beach and Volusia counties. The four counties used punchcard ballots, which state lawmakers are considering eliminating in favor of optical scanning equipment for the 2002 election in all 67 Florida counties. ELFRAD 114 Artist Ln Statesville, NC 28677 To whom this may concern: This is an open letter to all that are interested in the research of extremely low frequency signals, which propagate through the earth and the study, by ELFRAD concerning earthquake precursor activity. I founded ELFRAD in the year of 1984 for the purpose of conducting a study to determine the feasibility of predicting earthquakes with an unconventional method of detecting extremely low frequency signals, which are related to seismic activity. Using a direct electrical connection to the earth, rather than an antenna designed to receive electromagnetic signals, we have accomplished this goal. This will come as a surprise to most of you, who are familiar with seismic detection techniques, because earthquake forecasting is the Holy Grail of the seismic world. Independent researchers have discovered that sometimes, ULF signals in the range of .01 to .04 hertz can be detected in close proximity to a seismic fault line, hours or days before the actual event. This is accomplished using various types of antennae designed to capture this signal radiating through the atmosphere. This type of system has its limits however, because electromagnetic signals decrease logarithmically with distance. For instance, if a detection device receives 10 millivolts of signal located from a source 10 feet distant, you would receive 2.5 millivolts at 20 feet. 1.25 millivolts at 40 feet and so forth. This rule is called the Inverse Square Law. All radiated electromagnetic energy through free space must conform to this law. The propagation of seismic electrical signals through the earth however does not conform to this rule, and the losses are more linear. I have found that by using current detection between two ground points connected directly to earth, the reception of these ULF currents and voltages may be detected hundreds of miles from the source. Due to the long periods of time for completion of one cycle and the length of the waveform, I have found it impossible to construct an antenna array of the dimensions needed, to perform directional calculations, to determine the source of the signal. The ELFRAD detection system uses a different method to locate the source of seismic ULF transmissions. Due to the ability of being able to detect ULF signals from longer distances, we have discovered the amplitude of the detected frequency is variable relating to the nearness of the source. We have also found there are other signals with the same frequency which are generated by celestial objects such as the Sun during solar flares, and CMEs which cause magnetic fluctuations which appear to be from electrical seismic sources. Some of our receive sites are located on or near areas of high seismic activity while others are in quiet areas in remote locations. When an unusual signal indicating activity in the frequencies of interest, by obtaining data continuously from many receive sites, we are able to determine the geographical location with the highest amplitude. This data is received at a central location and analyzed. We are in the process of constructing ELFRAD standardized, monitoring sites in as many areas as possible, on a global basis. By standardized, I mean that all equipment, and software, which is used at all of the sites, is to be identical. This is a must in order to analyze and make use of the data. A typical ELFRAD monitor site contains the following: 1. An antenna array, which consists of two underground points which, are used as the input for the receiver. Each array is spaced at least 100 meters from the other in a North-South orientation. 2. A ULF receiver designed by ELFRAD, which has a band pass from 0 to 25 hertz. This receiver is totally electrically isolated from the other equipment. 3. A 16-bit analog to digital interface card to be used by Data computer. 4. Data computer which is dedicated to collecting and storing data from the receiver. Also functions as network interface to main computer. 5. Main computer which is used as network interface to data computer. This unit also performs initial analysis of received data. Connects to Central ELFRAD computer via dial up phone line. Also equipped for polling data requests. 6. Dial up phone line to be used to transmit data to Central Office. Also used for incoming data requests. At this point in time, all of the equipment has been designed, tested, and has been operational in ELFRAD monitoring locations for three years. I needed to be sure this concept was sound, and would perform as expected. I am now satisfied with the results and am ready to take the next step. When Bush invoked the memory of his late brother JFK, who sold his own tax cuts by promising to "get the country moving again," the Duke of Chappaquiddick couldn't even bring himself to applaud. And then there was Kweisi Mfume, who's not a congressman anymore but was on hand nonetheless, apparently on hiatus from cooking up new ways to smear Bush as a racist from his perch at the NAACP. Even when Bush promised to end racial profiling, Mfume retained his sour demeanor. And one can only wonder what Sen. [CTRL] AP: Tucker's Whitewater Fraud Conviction Upheld

(AP) -- A federal appeals court upheld former Gov. Jim Guy Tucker's Whitewater fraud conviction Tuesday, rejecting his claim that a juror at his 1996 trial was biased. Tucker has already completed his 18-month sentence under house arrest and was fighting only to clear his name. Tucker claimed that juror Renee Johnson was biased by her marriage to Charles Hayes a week into the trial. Tucker had denied Hayes clemency on a 40-year sentence for a drug conviction. Hayes' uncle was also an enemy of Tucker's, having distributed crude political fliers ridiculing him. Although she had lived with Hayes and their child for years, Johnson did not list Hayes in a juror questionnaire that asked about criminal cases involving family members. She said she did not consider Hayes a relative until they married. The 8th U.S. Circuit Court of Appeals at St. Louis ruled that Johnson had not necessarily been dishonest. Elizabeth Robben Murray, a lawyer for Tucker, said his legal team was disappointed and had not consulted with Tucker on a possible appeal. Tucker has been out of the country on business. Tucker was convicted with former President Clinton's Whitewater business partners James and Susan McDougal. James McDougal died in prison in 1998 and Mrs. McDougal served 2 1/2 months of a 24-month prison term. She also served 18 months on a contempt citation after refusing to talk to a grand jury. Clinton granted her a pardon last month, but denied Tucker's request for one. -Caveat Lector- http://www.foxnews.com/politics/022701/clinton_pardons_friedman.sml Rich Keeps Offices All Over U.S. Tuesday, February 27, 2001 By Roger Friedman NEW YORK Despite his former status as one of the country's most wanted white-collar fugitives, Marc Rich controlled a company with a New York-area head office and at least 17 branch offices that has done millions of dollars of business with the federal government. The company continues to operate today. Novarco Ltd. which has been registered since 1996 with the U.S. Department of Agriculture handles the export of commodities like aluminum and oil, among other things, to nations around the world. The company's international headquarters is listed as Zug, Switzerland, Rich's home since he fled the United States in 1983. Novarco also has offices in New York, Connecticut, Texas, Kentucky, the District of Columbia, Missouri, Louisiana, and Pennsylvania. United Corporate Services of White Plains, N.Y., handled Novarco's incorporation and acts as their caretaker for legal matters in various cities. The U.S. executives named in Novarco's incorporation papers include W. David Long, Mike Hopkovitz, Mary Ellen Yacura and Clyde Meltzer. The latter is the same Rich lieutenant who was indicted in 1983 along with Rich for participating in illegal oil sales and creating "daisy chains" endless corporate shells which kept changing names in order to conduct illegal commodity trading and sales of oil and metal. Meltzer was eventually given a three-year suspended sentence, placed on a five-year probation and given community service, according to the book Metal Men: Marc Rich and the 10 Billion Dollar Scam, by A. Craig Copetas. Hopkovitz when contacted at his Staten Island, N.Y., home to discuss Novarco's U.S. operations said: "No comment, no comment, no comment. I have to hang up on you." Meltzer and Yacura, who live respectively in New Jersey and Connecticut, did not return calls. Long is listed at a separate address about a mile from Novarco, also in an anonymous industrial park. Novarco's U.S. headquarters are in White Plains, N.Y., on the fifth floor of an impressive modern building high on a hill. On Monday, three women who work for Novarco refused to comment on the Rich pardon or the company's business. One woman said, "Call the lawyers if you have questions." "Marc Rich's lawyers?" she was asked. "Yes," she replied. Novarco is not Rich's first U.S. company to flourish since he renounced his citizenship and fled the country in 1982. For many years in the 1980s he operated under the guise of Clarendon Ltd., which dealt mostly in aluminum trading and oil refining. Clarendon was placed on the Defense Logistics Agency's debarment list for three years from 1984-87, after Rich began his exile. Clarendon, however, was removed from the debarment list in January 1988 and six months later it submitted a low bid on solicitation by the U.S. Mint. Clarendon subsequently won 19 other contracts for copper, zinc and nickel. During 1988-92, Clarendon made $45 million from doing business with the U.S. government by selling copper, zinc, and nickel to the U.S. Mint for making nickels. That was until then-Rep. Bob Wise, D-W.Va. now governor of West Virginia got wise and helped put a stop to the practice. Rich was subsequently listed on the General Service Administration's procurement black list. Beginning in November 1990 seven years into Rich's fugitive status Clarendon was involved in a high-profile labor dispute at the Ravenswood Aluminum plant in West Virginia. A total of 1,700 steelworkers were locked out of their jobs in a nasty long-running fight in which it was proven Rich had bought Ravenswood from Kaiser Aluminum in 1989 under the Clarendon name. Rich also operated an international company called Richco Grain, which was caught exporting American grain in the early 1990s by the Department of Agriculture. Rich surreptitiously received $65 million in subsidies from the department's Export Enhancement Program. This prompted then-Rep. Dan Glickman, D-Kan., subcommittee chairman (and Agriculture Department chairman under Bill Clinton) to say during congressional hearings, "You have yet to tell us how the largest tax evader in the history of the United States of America, one of them, was able to participate in the EEP." Richco Grain was suspended from doing business by the U.S. government. But in 1997, Rich tried to make a comeback in commodities. He purchased a small existing company and renamed it Novarco Agriculture. After two years, the firm shut its doors. But its goal, according to one former staffer, "was the procurement of U.S. grain for international sales." This, despite the Richco suspension some years earlier. "It was an open secret," said a former Novarco Agriculture staffer. "We were told to be up front about who we were." The company did business with 30 or so grain wholesalers. Barney Frank of Massachusetts. ``The amendment I am introducing would prevent this pattern from recurring.'' Like his presidency, marred by a sex scandal that led to his impeachment, Clinton's post-presidency was beset from the start by controversy over a flurry of last-minute pardons. So far two congressional investigations have been launched into the pardons of fugitive financier Marc Rich and others. The U.S. Attorney's office in New York is also probing Clinton's pardon of Rich and his partner Pincus Green. Rich fled to Switzerland 17 years ago to avoid prosecution on more than 50 counts of racketeering, wire fraud, income tax evasion and illegal oil trading with Iran. Any constitutional amendment would be difficult to pass, especially in a narrowly divided Congress. It must win the support of two-thirds of lawmakers before it can be sent to the states for ratification. Under Frank's proposal, future presidents would be barred from issuing pardons starting one month before the November presidential election until a new president is sworn in. Frank's amendment would not restrict the ability of a president to delay executions. Frank said his proposal would ``amend the Constitution in a way that leaves the beneficial aspects of the pardoning power intact, while substantially reducing the chances that it will be abused.'' You invite a friendly couple that you just met to your home for dinner. The food and company are fine and everyone is having a good time. That is, until your 19 year old comes home from a night out. After he politely introduces himself to your company, one of the visitors gets an immediate migraine headache and must leave your home immediately. What happened? Your son was wearing an aftershave. And your visitor has terrible reactions to fragrances. The brief encounter made your guest very, very ill, and she'll remain ill for many hours. Does this sound improbable? It is not improbable. It is very common. Many people in this country suffer from Multiple Chemical Sensitivities (MCS). Previously unheard of, environmentally aware physicians throughout this country are now diagnosing their unfortunate patients with this illness. These people suffer from exposure to various air-released chemicals, such as smoke, cleaners and perfumes. While the list of irritants can vary greatly, fragrances are often near the top of the list of offending chemicals. Just ask Connie Pitts, 47, of Aurora, Colorado. Just recently Connie was diagnosed as suffering from MCS by her local MD. Her symptoms are instant left-sided migraines, cognitive problems, fatigue, burning eyes and sometimes alarming heart palpitations and shortness of breath. Her triggers, in other words what makes her feel ill, are perfumes and other artificially scented products. And if you haven't noticed, we live in a world filled with scented products. Her symptoms can take 24 to 48 hours to clear. According to Connie, her "life has been tremendously altered, as I am primarily housebound now. MCS makes life frustrating and lonely." Other than taking Tylenol for the pain and resting a lot, there is little relief available for her. "Sometimes I don a mask to shop, but getting stared at is also difficult to take, emotionally." Fragrances are a real problem for Connie, who is not bothered by car exhaust fumes, pet dander, or even second-hand smoke. She said that since fragrances appear to be unavoidable, she is often forced to remain housebound. Can you imagine having to live that way? Fortunately, Connie is not alone. And the internet, of all things, has helped to bring MCS sufferers together. " When my symptoms worsened, I went to my computer looking for answers and discovered that millions of people across the country suffer much the same as I do. We communicate via email. The internet has given me the chance to correspond with others who understand how I feel, and we offer each other support and hope." MCS is a tremendous problem. Because so many sufferers are out of necessity homebound, no one knew these people and this problem existed. The internet is helping to solve these issues, but rules and laws are needed and attitudes must change. One Canadian municipality has already taken measures to prevent people from wearing fragrances in public. Some American hospitals are doing the same. But so much more is needed. Why does everything have to contain a fragrance, when fragrances make some people become very ill? Just because the majority of people feel no effect when they encounter fragrances does not mean that those who become ill should be subjected to fragrances. The public use of fragrances and perfumes is causing a problem for a real, albeit small percentage, of Americans. While perhaps small in percentage, numerically I suspect we are talking about a lot of people. If we really care about our neighbor, care about those who become ill when they encounter fragrances in public places. And remember Connie Pitts, who told me, "MCS has robbed me of happiness, as I cannot make plans or dreams for my future."
