Search led me to your blog, and although I didn't find the Sotheby story, I liked what I read enough to plan on going back to read your blog more thoroughly. (I've never had a case against me brought to court, ever - despite countless threats over 30 years, because I know the differences between libel/defamation/slander laws in the U.S. vs. in other countries.) * However, there have been other instances where my actions resulted in published stories, the most notable being my complaints against Christie's London in December 2003 and the claimed destruction - by a consignor - of a rare six-sheet from The Outlaw - an action designed to preserve Christie's marketing claim of auctioning the only copy of this title in this format in the world. * My angle was to assail the purposeful destruction of art (as noted in a statement issued by Christie's) - to boost perceived rarity - while expressing scepticism of the claim that the consignor's extra copy was destroyed. My actions resulted in stories published in many publications, including the London Evening Standard, the London Daily Telegraph, the Antiques Trade Gazette and the San Francisco Chronicle, the latter being the news organization closest to the consignor's residence. In subsequent years, the hobby learned the claimed destruction of extra copies of The Outlaw six-sheets was an outright lie - as the same consignor - through intermediaries - brought more copies he had in storage to the auction block. All of this happened during my years as a writer and consumer activist specific to the poster hobby and the practices of auction houses worldwide. I ended such campaigns when I decided to get out of the hobby and re-think my priorities after the wildfires swept through our area in 2003 and 2007. * In relation to your complaints, in my view, the media would NOT be interested in your tale unless you were able to prove a large loss and/or a pattern of errors from Heritage similar to yours. If I were in your shoes, I would take another stab at trying to work things out with Heritage's customer relations and P.R. departments - so you can put this incident behind you in a less combative way, regardless of your consignment intentions in the future. In my experience, dealing direct with P.R. and customer relations personnel is almost always more effective than dealing with lawyers. Within corporations, there is constant friction between legal and P.R. departments - and I strongly feel consumers can get more things done when dealing with such people because they are paid to be responsive to complaints to protect a company's image. Dealing with in-house lawyers who love to battle consumers with threats of court action get you nowhere and only makes consumers angrier. Again, bad P.R. is generally way more damaging to a company than a lawsuit - unless that lawsuit is brought by a consumer as a class-action complaint. David

If you're a fan of small indy films, here is a really great one. I saw this Belgian-French-Italian co-production in Dallas at the Angelika this weekend. A simple story made great by great performances and great direction. From wikipedia (there's more there if you insist on the spoiler.) The Kid with a Bike (French: Le Gamin au vélo) is a 2011 drama film written and directed by the Belgian brothers Jean-Pierre and Luc Dardenne, starring Cécile de France and Thomas Doret. Set in Seraing, it tells the story of a 12-year-old boy who turns to a woman after his father has abandoned him.[2] The film was produced through companies in Belgium, France and Italy. While it does not deviate from the naturalistic style of the Dardenne brothers' earlier works, a brighter aesthetic than usual was employed, and the screenplay had a structure inspired by fairytales. [MOPO] KERRY HAGGARD WAS SENTENCED TODAY!
After three long years I am happy to say that Kerry Haggard was sentenced. The Judge threw the book at him, giving him the maximum sentence possible of 78 months in Federal Prison. She would have given him more time, but then it might have opened the door for an appeal. 78 months is the maximum with no appeal opportunity. She obviously didnt like Haggard and lectured him for about 20 minutes. He requested a transfer to the Atlanta Federal prison. She refused to let him transfer to a Federal prison closer to his home in Atlanta. As a matter of fact, she also gave him three years probation after that, requiring it to be held in New York also. Which means, he will have to live in that area. He cant go to Georgia to do his time or his probation. In terms of restitution, she sentenced him to $1.377 million to be reimbursed to the hobby. Unfortunately, they cant make him give posters back. They can hold his feet to the fire, but can't actually make him give them back. The good news is that Agent Mike Mullahy has found at least $300,000 in good posters. (They also confiscated many other fakes.) The Judge order that all funds raised from the sale of these posters go to the victims, not the Government. Each victim was listed in the sentencing, with the amount due to them for reimbursement. It was also implied that there may be more charges coming. I am not certain of this, but it sounds like there are more potential legal actions in Haggard's future. I can't convey how much disdain the judge had for Haggard. There are some real positives from today. First of all, the judge was greatly influenced by the letters that everyone sent to her. She said she had never received so many letters in a case, ever! Thank you to each person who wrote a letter. Also a thank you to Robert Ragovin and Glenn Damato who spoke in court along with myself. Ralph De Luca was also there lending support. I want to send a special thanks to Sean Linkenback. He knows why, and thats all I will say about that. Our hobby owes a special thanks to the FBI. Specifically Agent Mike Mullahy. He did a fantastic job. He talked to me day night. I remember one time he contacted me at 10:30 on a Sunday evening. He went over and above. Jim, Thanks for the tenacity in which you pursued this not only for yourself but for everyone victimized and the Hobby as a whole. I can only presume Haggard's good ole' boy demeanor didn't even cause a dink in the Judge's armor. Excellent. Early release from 6 years and 6 months I take it is not in the cards for him. 6.5 years puts him somewhere around the second year of Hillary Clinton's Presidency. Awesome. It sounds like the Judge did not take these offenses lightly. I hope that Mr. Haggard will reflect on his bad behavior and come to feel truly sorry for the pain he has caused and for the distrust that his behavior generated. Maybe he never will. But 78 months excised from his life is no small matter. And he will have a lot of time inside to think about honesty and how it really is the best policy.
