Sorry. I've exhausted the limits of my expertise. However, it does seem possible that the limitation here isn't in pcap, but is in the driver (since that's the only thing that changed). If the driver doesn't support promiscuous mode, the fact that the layer above and below it (net card and pcap) both do support it probably doesn't matter.
Is it possible that the older driver just didn't fail when promiscuous mode was requested? I know you said that it used to work, but I remember when I first started using pcap (not that long ago), I thought I was getting p-mode even though I had disabled it. Turns out I was just misinterpreting the dumps. Not much help here, I know. But it's all I've got to offer.
