Amiyo da, Has your state government identified jobs for the disabled? Check
which jobs are being advertised and if West bengal has identified these jobs
for the Blind then you can raise an issue.This means identified for totally
Blind but advertised for Partially Sighted.
If these jobs are not identified by the State Government but by the Central
Government then also you have a chance. This means not proper
identification.
If West Bengal has not identified any jobs then you have a good case. This
is violation of the Act.
Please go to Court and not the Disability Commissioner.
Also note that it is not the noise made at the street level that works but
the effort put in by organisations to sit with volumes of paper in the
language of the state.
It takes days of work to really see the discrimination. In Mumbai NAB
officials had to sit for days to see if the identification was proper. No
lawyer can help in this job. It is thankless and back breaking.
Checking advertisements against identification is also difficult.
Easiest is if the state has not identified then you just have to file a writ
petition stating that there is a violation of the Act.
Dont take up these issues if your organisation does not have sustained time
and money. Half hearted attempts ruin the matter completely.
The Maharashtra case is pending since 2002. Without resources I find myself
constrained. I am not inclined to push the matters because of my resource
crunch. No body else including the judiciary realises that the Blind
community is suffering because of the delay.
even then do not go to the Commissioner of Disability.

Employees State Insurance Corporation recently advertised in the latest
Employment News a job notice for recruiting about 100 LDCs. In case of
reserved posts for vh candidates, they have specified that only persons
having visual disability from 40% to 74% can apply. If I remember
correctly, there was a protest in Maharashtra against such discrimination
between low vision people and the totally blind people. I would like to
know if we can do anything about it. This Corporation is under the Labour
and Employment department of the Central Government.
