Agreed.  It can create an atmosphere for race to the bottom pricing.
With little to no barrier to entry anyone can come into the market
undercut the existing providers with cheap land grab tactics.  These
providers typically don't last and go out of business, but they drag
down legitimate companies with them.  It happened plenty of times in
the golden age of dial-up.

I despise over regulation but it could create a large enough barrier
to entry that only serious operators would enter the market and that
might prevent race to the bottom, at least for a little while.

All that being said, I don't agree with a monopolistic environment either.

That seems pretty obvious, DCMA violators will just keep jumping to
the next service provider any time their current provider is forced to
turn them off.
