Both of those are too simple for my taste, but I prefer #1 to #2 given only those two choices.

One of the interesting angles is people creating churches/religions for no reason other than tax avoidance. So the definition of a "church" or "religion" needs to be tightened up.

2) The constitution infers that Churches and religion are supposed to steer clear of all things public and politic.
