I find that it is quite open. Both the target and initiator are available under
the GPL.

I was not aware that they made an HBA. Although I recall a while back (nearly
two years ago) running into someone (although I thought he was in France)
looking to bake AoE into an FPGA or something. Maybe this is what became of
that work.

You don't need an HBA to use AoE in general. I use the Linux aoe kernel module
initiator. ESXi, although it is based on Linux, does not have the aoe kernel
module initiator as far as I know. So the HBA may be your only way to go there.
But AoE itself is definitely not proprietary. That was a smart move by Coraid
or it would never have gone anywhere. I'm still a bit disappointed in Coraid's
marketing in that I am yet to meet anyone who has heard of AoE who isn't from
this list or I didn't introduce AoE to. The simplicity of AoE should be a huge
selling point but from what I can see it just isn't making much impact.
