patched it away:

If it happens all-the-time, then yes.


I'm using ath5k together with iw/wpa_supplicant in -Dnl80211 with 
great success. However, I make sure that I'm using quite current 
software. This means often to "roll my own", e.g. self-compiled 
kernel, self-compiled iw because the otherwise great Debian 
sucks here.

That said, ath5k seems to be pretty stable nowadays. The number 
of patches isn't that high anymore:
