I'd also recommend someone contact Pragma and ask why he used the sounds and music he did if it was piracy. Something other than the game is free, of course. Until that's done, this is all speculation. As it is, I don't personally see a problem with what was done, mostly because no one's making or losing money. I don't make the law though
The problem with copyright law in most cases is that people are greedy jerks who take the law too far. However, even though I feel that way, I would have to put that aside and do what must be done to keep the forum out of trouble if I was a moderator. That's what the moderators do here. If you want to blame someone and call them heavy-handed, blame corporations and their lawyers for being unreasonable trolls when people mean no harm. The moderators are just doing the best they can with what they have, and attacking them really isn't fair.
