This will probably be long. I wish I knew how I could help my daughter. There were a brother and sister that owned adjoining properties. The brother built a carport on his and went over his sister's about two feet. Both knew it and did nothing to change the deed. They listed their homes for sale and neither of the sales agreements disclosed that fact. My daughter purchased the one with the carport and a strange guy purchased the other. Shortly after he started harassing them that the carport is probably on his property. So he spent $300 to have it surveyed and the carport is in fact on two feet of his property. Susan sought legal advice and was advised to try and buy the two feet. Her husband spoke to the neighbor and he wanted them to file a law suit against the brother who built the car port. Now every day for two months or so he has made some comments about the carport, first he said he did not care. Susan was under the impression that he was trying to come up with a reasonable price to purchase. Well yesterday she received a letter from his lawyer wanting Susan to pay $1500 legal costs, $300 survey charges and $75 a month to rent the space. The space is 40 square feet. Michael went over to tell the neighbor that he will be taking the carport down. The guy said he did not want that to happen and he thought they would go after the former owner. Today he told them that he still wants them to pay his $1500 legal fee and $300 survey cost and a little more for inconvenience.
