I have no idea if all states and more than likely it is not the same.  In
saying that I bought a two city lot and at the time according to the map
given to me It was said that the lots together were 100 feet all the way
around. This last summer a guy bought the house on one side of my back
property line. One now belonging to the Samolian Church that formerly
belonged to the Servant of the Lord, which I bought from. Then changed hands
to the root-cellar and now this Church. Well this new neighbor with his 50
feet across my back property line was making a fuss. So I said this is what
I am going to do. To which found out the map at sale was not a legal survey
map. So surprised but hired a legal city/county certified surveyor and her
team came over. After some research was done the pins were put into place.
Findings? The sides from front to back I owned 1.5 more feet on each side.
The rear fence because of the street behind and in front of the Church runs
at a bit of an angle the back line I found out that I owned 4 extra feet and
tapered down to the other side to 2.5 feet. So once the map was certified,
mapped out for me in two copies and stamped with her stamp and the
Cumberland County stamp and a legal letter and $1,500.00 and the pins in
place...
The first thing she informed me:
A: you can leave the fence where it is and the extra land in 20 years will
go to the people abutting your property. Being I've been here since, full
year, 1994 as moved here in 1993 of November. Well you can see that I needed
to do something, as the 20 years closing in. So, one fence was moved and the
rest will be moved next String/Summer.
This is another law that I did not know about. That is no structure can be
within 6 feet of the boundary line, but, a fence can be within 1 to 3 inches
of the line, it can't be on the line.
So, in some cases it is not a big deal. Yet as you can see in your
situation, as here it is a big deal. In fact the first fence moved the guy
that owned the open parking lot, I thought he was going to have a heart
attack. Yet calm down and said I guess it is legal with the map and legal
letter stamped with the proper seals. The new guy behind me with his new
fancy small home and fruit trees, my son says, is having a fit as he ran -
between him and the Church a cedar 8 foot high solid board fence and heavy
duty cedar post right up to my present fence. Yet showing him the documents
and reminding him he is the one that filed the complaint and he is the one
that all he had to do is clean up to the fence line, but, no, make a fuss.
The Church is really up-set with that much but seeing the paper work ok..
The more serious one a little concern is the drug house next door and their
very large husky shepherd guard dog and stuff piled up against the fence. So
why mess with it? Simple as  Lenny 's family is or did find out and if I am
going to sell one day..
