Is this property a city lot or more of a rural parcel?  This is important 
because most cities have ordinances dictating the width of property lots.  A 
rural parcel may fall under the 5 acre restriction, but it wouldn't be very 
difficult to establish a mutually agreed upon exception; I doubt that you'd 
even need a lawyer for this.  The bottom line is that for one consideration 
(the neighbor surrendering control of the 2 -- probably 3 -- yard strip) 
should be offset by a negotiated consideration on your daughter's part. 
That consideration would probably be monetary.  The point being that the 
neighbor will be surrendering value (the strip) and should be compensated in 
return.
