Is your daughter in Pennsylvania?
I thought that in PA if something is like that for 7 years it becomes 
property as property.
The real estate offices are gonna get dragged into this as there was a 
certification of deed and inspection done before sale?
I'd say rip it down, and tell the guy he didn't have to go to a lawyer. 
Pay for repairs to his ground and let it go to small claims court.
