True. If pointing a gun at your enemy during combat would be a crime, every
soldier who was ever been in actual combat would be a criminal.

And the lawyers of "these guys" would probably argue that their clients were
acting in self-defense anyway...

Probably not, but that is not for you (or for us), but for their judges to
decide. Despite their apparent membership of AQ or Taliban, they are
innocent until proven guilty in a court of law.
