It seems to me that is an unproven assumption. I think we need a fair
"pre-trial" to determine the status of each prisoner, i.e., are they AQ
or not, are they guaranteed Geneva Convention protections or not, and so
on. Mistakes can be made. A fair trial makes mistakes much less likely.
