Sirius only has about 800,000 subscribers and XM has about 2 million. If these numbers jumped into the 10s of millions the FCC would have no choice but to push it's authority to a decisive battle.

Cable has a package business model though in that you buy and entire channel selection. That means all channels in that selection are effected by other's programming. However, the Spice Channel still exists as an add on. Currently satellite radio is an all or nothing deal.
