You make a good point, but I think it will help push a fight into the
courts that will force a rewrite of the FCCs charter.  Sirius only has
about 800,000 subscribers and XM has about 2 million.  If these
numbers jumped into the 10s of millions the FCC would have no choice
but to push it's authority to a decisive battle.

Don't count on the Supreme Court though!  Mr. Bush may nominate up to
4 justices and, based on his track record with your freedoms, you can
expect his justices won't give a hoot about your liberties.

Cable has a package business model though in that you buy and entire
channel selection.  That means all channels in that selection are
effected by other's programming.  However, the Spice Channel still
exists as an add on.

Currently satellite radio is an all or nothing deal.  They may be
forced to move to a package model.
