Your argument fails on so many levels it's hard to know where to start. I'll take a shot: 1.) Logically. It's almost too obvious to state, but this is the nature of justice. With the rise of DNA evidence we've seen the gov't protect murderers (by failing to prosecute them) while punishing innocent citizens. While our legal system could be improved I doubt you'd argue we throw it out. 2.) Legally. The ACLU is not a protector of WHO, it's a protector of WHAT. They protect the constitution and when anybody violates it, if they know about it, they point this out. If the gov't is found guilty then they're liable for damages just like any other defendant. 3.) Reasonably. If the ACLU is winning cases against the gov't it's an indictment of the legal system not the ACLU.
