I can't help but feeling like there were extenuating circumstances here, some 
thing like this.

Officer: Miss, you can't eat in the metro
12 year old: So?
Officer: It's illegal
12 year old: You're not my father, I can do what I want
Officer: Miss throw away the fries, and get on the train
12 Year Old: No, fuck you, leave me alone

escalates from here.....

at this point she's committed two crimes in DC

1) Eating on the metro 
2) talking back to an officer

I really don't think he just walked up to her and arrested her on the spot.

A fine may or may not work, it doesn't drive the point home. Because the minor 
has no financial responsibility for it. If you take her into custody, and 
detain her until her parents show up it makes the point.
