I can't help but feeling like there were extenuating circumstances here, some thing like this.

Officer: It's illegal 12 year old: You're not my father, I can do what I want Officer: Miss throw away the fries, and get on the train 12 Year Old: No, fuck you, leave me alone escalates from here..... at this point she's committed two crimes in DC 1) Eating on the metro 2) talking back to an officer I really don't think he just walked up to her and arrested her on the spot. A fine may or may not work, it doesn't drive the point home. Because the minor has no financial responsibility for it.
