This is Sam's confusion: he doesn't understand that this "moral" is actually just the enforcement of The Golden Rule. That is, the perpetrator is preventing that 12 year old from pursuing his/her freedom. We arrive at this conclusion because we've decided by reason, rather than culture or religion, that a 12 year doesn't have the facilities to make competent sexual decisions. With gay marriage, for example, both parties are willingly participating. Banning Gay Marriage, therefore, is using the State to prevent free will; a violation of The Golden Rule. Benjamin Franklin called these truths "self-evident".
