Yep. It is illegal. But if you follow the courts at all, you will see that popping a guy in the nose for patently offensive speech is often if not usually forgiven by prosecuters and jurors.
If not, then the person doing the hitting has to accept the consequences of their actions. I don't think that, as a rule, people should be hit for offensive speech. And what constitutes offensive speech will differ by situation, timing, and the people involved. But sometimes I think it is warranted. For example, when someone gets in the face of a grieving widow who lost her husband in Iraq and tells her that he was a coward and deserved to be killed (I witnessed this in person), he deserved the ass-kicking he got by the girl's brother. There was no other societal mechanism that could handle this (or work quickly enough), yet it was mean and cruel and was not something that should be tolerated. The violence was, in my opinion, less offensive than the speech. I think if there was a little more school-yard rules in our society, it would actual be a better place.
