It's called the power of the purse... in the article I read covering the issue there is a wonderful quote: "Colleges and universities did not challenge the law. They had $35 billion a year in federal aid at stake." (as found on the LA Times story http://www.latimes.com/news/nationworld/nation/la-na-scotus7mar07,0,697174.story?coll=la-home-headlines) The Federal government has a LOT of power in our educational system. At the private for-profit college that I teach at we are bound by federal rules and regulations for our student's attendance. As a college teacher I have to personally communicate with any student that is absent on the day of their absence and if they miss more than 21 consecutive days in any class they are dropped from that class. This isn't because of a rule that my college has, it's because of restrictions from federal funding sources. Want to know where this has happened in the past? Let's see... know how every state in the union has a seat belt law? How'd the feds get the states to apply the exact same statute to all of their law books (seat belts fall at the state level not the federal)... by threatening to withhold financial assistance for roads. What about the fact that for every state in the nation the drinking age is 21 and the smoking age is 18? That was a funding threat as well... though I can't remember if it was highway dollars or something else.
