A) You own the list. You can run it as you please.

B) If I start a new list, I can run it as I please.

C) Neither list is owned by the government and the primary resources for the
list are provided by private parties; therefore, there are no First
Amendment issues involved in how the respective lists are run.  I would have
every right to ban you from my list for violating list rules. You would have
every right to include messages supporting your religious views in headers
and footers of your list. You could even require that we all swear or affirm
a belief in God as you define God. There is nothing I or anybody else could
do, except leave, if you choose that path.

Again, the analogy is spurious since there is no government action involved.

I've decided that Howard is right. I have every right to impose my
religious views on anyone I want. For this reason, the lists and all
related resources will be closed down from Friday night to an hour after
sundown Saturday nigh as well as all Jewish holidays. In addition, the
new footers of the list will praise the words of the Torah while saying
how all other religions are wrong. I may even put in headers asking
people to convert to Judaism before each post. Of course, you have the
right to leave the list but then you loose the resource. You can even
start up your own list but I'll come there as well and do the same. If
you ban me I'll sue for having my first amendment right being taken
away.
Of course, I can also spam you and you have no right to stop me from
doing so. Think of me as a teacher teaching in a class. I'm just getting
my message across. All you can do is not listen.
