The Constitution of the United States, Art. III, defines treason against the United States to consist only in levying war against them, or in adhering to their enemies, giving them aid or comfort. This offence is punished with death. By the same article of the Constitution, no person shall be convicted of treason, unless on the testimony of two witnesses to the same overt act, or on confession in open court. So unless through legal manipulation you could somehow prove that getting the US into war via lies and deception consists of levying war against the US or giving aid and comfort to the enemy, technically Bush is not guilty of treason. Article II, Sec. 3, U.S. Constitution says: "The President shall from time to time give to Congress information of the State of the Union and recommend to their Consideration such measures as he shall judge necessary and expedient." If I were pursuing legal action against him, I'd go after him for contempt of Congress, for lies and deceptions presented in the State of the Union address which violate the very heart of this clause and as such, should be an impeachable offence.
