I ain't no lawyer, but I can tell you that I've heard from both
nationally recognized constitutional scholars and international law
experts.  According to them Bush, Cheney, and others are not only
under jurisdiction, but the evidence of commission is overwhelming in
that Cheney, for one, has openly admitted his complicity in war crimes
numerous times on television.

According to them it's as if Cheney is saying, "yeah I did it, try to
catch me" and/or "fnck you" to world court.

It's just not a good situation.  But I agree that there's probably a
way out of it and if anyone can find it it would be Obama who's a
constitutional scholar himself.
