There is not distinction between "enemy" and "countryman" and, as
Larry points out, the US is BOUND by international law and treaties
that it willingly signed which carry a set of law it volunteered to
abide by.

And, as Larry also points out, beyond THAT is US Federal Law.

And, beyond THAT, is the US military code of justice.

A lawyer's "advice" is guidance, not law.  And their "advice" does not
shield you prosecution from the law.  At best - BEST - you can argue
that a law is sufficiently complex such that you didn't understand
legality, but even THAT does not prevent enforcement of the law.

In this case all 4 branches of the armed services and the CIA are
documented as having the "mens rea" that this is possibly illegal.

And Rummy is documented as telling to to stop with the investigations
of legality and to proceed with the torturing.
