There is not distinction between "enemy" and "countryman" and, as Larry points out, the US is BOUND by international law and treaties that it willingly signed which carry a set of law it volunteered to abide by. And, as Larry also points out, beyond THAT is US Federal Law. And, beyond THAT, is the US military code of justice. A lawyer's "advice" is guidance, not law. And their "advice" does not shield you prosecution from the law. At best - BEST - you can argue that a law is sufficiently complex such that you didn't understand legality, but even THAT does not prevent enforcement of the law. In this case all 4 branches of the armed services and the CIA are documented as having the "mens rea" that this is possibly illegal.
