Even the pilot describes the situation as a man gathering the wounded. And the troops that were "seconds away" could've been told to hold their positions in the same amount of time it took to request permission to engage again. There's uncountable possible reasons why it might be justified to engage the men on the ground. Listing all the possibilities does fuck all in this conversation. The gunner took it past justified when he bold faced lied in order to allow him to engage the van. It had fuck all to do with there being any threat, real or perceived. He was stopping a guy from tampering with the evidence. What if it was a cop who made an honest mistake and shot an innocent man? Does he get a pass to shot all the witnesses too?
