My wife (the agent - hehe) will tell you that the easiest way to get sued is to represent the buyer and seller in a deal. Even though the agent will make more money by attempting to represent both - it's flawed due to real estate laws that require the agent to represent the seller before the buyer.
Its a much better idea to get a different agent than the one that is selling the house. Regardless, agents pay for insurance on each of their deals (if they are smart), if they get sued it costs them nothing. Real estate laws are strange - for example, the statute of limitations is 7 years from the time you learn of the issue. -That basically means the time limit is eternal.
