In this society you cannot take the government out of marriage. There
are over 1700 federal benefits for married couples. That doesn't
include inheritance rights, guardianship, etc. If you want to remove
government from marriage, you'll have to remove all of those benefits.
And there will be a howl from all the straight married couples against
that.
