In neighborhoods such as this, with townhouses, the 'property' may have been 'common ground'. When we lived in a townhouse, we did not own the grass outside, it belonged to the complex, as such they managed it - mowing, etc. So Martin may have been on 'common ground' as much as if he was on the sidewalk.
