the boy and his father were in arms against the US. It is no different than the estimated 3000 Americans who fought for Germany in WW I and the 1500 or so who fought for the Nazi's in WW2. And in both cases (WW1 and WW2) those Americans were killed without due process for the same reasons. They were trying to kill other Americans in effectively an active battlefield.
