Only Washington state and Colorado have recreational pot legalized...everywhere else, it is still a criminal act. States that have medical marijuana laws require that you have a card for it. If you do not have that and do not live in a state that has legalized medical marijuana...it is still a crime. Not an infraction. Many states have reduced the penalty to a fine and made it a ticket-able offence rather than dragging you to prison off the bat...that doesn't mean that it is not a crime still. While I disagree with it being a crime anywhere...as long as it is, you have to play by the rules or be prepared to pay the piper. Don't blame someone else for actions you took knowing full well that it was against the law. No one forced tyou to smoke.
