Just curious, considering the below WHOIS output, how did that somebody you
work for deliver the subpoena?

spews.org whois-output:

Nothing. Last time I checked the entire SPEWS organization was outside US
jurisdiction (unless one of the unknown operators lives in the US, but we
don't know that).

SPEWS doesn't list open relays. It lists ISPs that don't respond to spam
abuse reports. Check the FAQ.

Read NANAE for a while, there are plenty of ISPs that get out of SPEWS. Or
check the old list: http://www.spews.org/news.html

Actually, they even state in their FAQ that it is just their opinion and
warn people that using SPEWS will result in undesired side-effects.

SPEWS does not list open relays, so that must have been with some other
blacklist. And I have never seen a single complaint about an incorrect
SPEWS listing take more as 1.5 hour to be corrected.

Unlikely, I don't like double optin either :-)

A little explanation on the differences between the optin types:
single: anybody can opt you in by pretending to be you
double: anybody can opt you in, they just have to do it twice
confirmed: after initial opt in the opt in is verified by sending an email
with a unique code to the opted in address. You are only listed
if you answer with the unique code.

RFC 3098 sets the standard.

They most certainly can. It has happened in the past that other lists put
in domains for other reasons. I don't recommend those lists anymore.

> I hope they loose their equipment in court for failure to appear.

Quite unlikely. But if it happened, I would be happy to host them for free.
