That's kind of the point tho:

The constitution protects these rights against this very kind of short
term hysteria.  History is littered examples of a panicked populus
making a snap judgement and then, years later, wondering "how'd we ever
get here?!"

For the uber-geeks imagine how pain could have been averted if Jar-Jar
was unable to give supreme executive force to Palpatine through a simple
proposition.  ;^)

Today the government is doing it's best to cover-its-ass and the media
is doing there best to scare the crap out of us.  All of this gives the
people an unreasonable sense of fear and danger.  The safegaurds placed
in the constitution (and the constitutional ammendment process) are
there to prevent this kind of temporary situation from threatening the
fundamental ideals this country was based on.

Despite some bumps (McCarthyism, WWII Interment camps and others) they
have done a fine job so far.
