I agree that this will probably be brought to court, since I'm pretty sure someone will sue, eventually.
One of the "loopholes" of the "do not call" list is that companies you have done, or do, business with can still call you. From a certain point of view, trading info in exchange for some product could be seen as doing business. Whether or not the "fine print" is a little too fine is open to interpretation, which is what the judicial system is for.
