If the parents have the means to do so I would encourage them to bring legal action, personally. Especially against the school which in my opinion has the responsibility to provide a safe environment. They will hear lots of whining about the taxpayers' money, but should remember that they ARE the taxpayer (right?)
And if it were me, yes, I would insist on bringing criminal charges with great prejudice. Tell them to be prepared for many people to try to talk them out of it, and for lots of blaming the victim. I have been though this, and my thought at the time was that hey this si my kid and if his mother won't stand up for him these people sure as heck are not going to. Also, since this kid apparently attends the same school, I would make a great noise about how this child need to not have to worry aboput running into this other kid in the halls tomorrow.
