Whether or not the code is bad can in some cases be a moot point.

When faced with this sort of scenario, you have to make a decision. If the
code has never gone live, I unquestionably re-write it. If its live and in
use then I ask myself the following questions: Does the bad code work? Are
the users happy? Is it a real showstopper if the code doesn't change? Is
there enough time to do this and get all the other work done too?

If the answers to these questions are favourable to re-writing then it gets
a re-write. If not, it stays as it is until more conditions change and a
re-write becomes a possibility.

It is a pain and I can probably point to a few bits and pieces of code that
I know are running live at the moment where I'd like to change them but
commercial pressures dictate otherwise and the sites aren't 'broken' because
of it.

At the end of the day, its a judgement call and if your senior is the one
doing the judging, don't get worked up about it, just leave it at the door
when you clock off at night!
