Well, after much "to-do" last night, Max and I finally came to a 
compromise. He didn't want to do that crate no matter what and cried 
and cried for a very long time...becoming frantic. It just wasn't 
worth it to me. Finally he slept in bed with me, perched on my 
sholder, and that is where he stayed all night. We all slept well and 
he didn't potty until I got him up and on the newspaper! He is such a 
good dog! So I had my chocolate lab on the floor next to me, my 
daschund at my feet, little Max on my sholder and my hubby at my 
side! who could ask for anything more? I do appreciate all the 
suggestions I have gotten and will continue to try them. I do want 
Max to get used to the crate, if not for at night, then at least for 
sometimes during the day...as he is too little to just run around 
unsupervised.
