It is my understanding from the last time this issue was hashed out on the
List, we learned that the Code of Ethics of CKCSC, USA is an organizational
policy that can only be changed by a vote of the membership.  I suspect that
some other organizational document, like the Articles of Incorporation or
the Organizational Bylaws dictate that procedure.  Changing these latter
documents also require a vote of the membership.  This is probably the basis
of the attorney's position.

This issue is a CKCSC,USA policy and procedure matter, however, both
CKCSC,USA  and ACKCSC are the stewards of the breed, and could, if they
wished, work together to reach "d�tente" on this issue.  This is really not
a health testing issue -- that is a useful detractor.  Why require this,
when the Club does not require for its own members [although many of us
breeders individually do for our own purposes], and it is not required for
imports when registering them with CKCSC.

What I believe is best for our breed is that breeders be given the
opportunity, without the scepter of discipline, to breed for the best
outcomes, notwithstanding the US recognized registry of their dogs.  If in
the judgment of a breeder that means AKC-only registered cavaliers  with
dual registered cavaliers -- why shouldn't that be a responsible practice?
I'm sure, the CKCSC,USA  can figure out how to exclude the "odd ball"
registries that exist, not only in the US, but internationally.

While we cannot control most things in life, we can, at least, on an
individual basis, exercise responsible judgment.  Resolution of this matter
will not occur easily because of the organizational legalities within CKCSC,
and the monumental difficulties of objectively educating the membership in a
timely manner.

The governing Code of Ethics is for all Club members, although the
preponderance of the verbiage is about breeding and showing.  Whether it is
feasible and/desirable  without a vote of the total membership to
reconstruct the Code so as to have a portion governing all members, and an
additional portion governing Breeders, is worth exploring -- but I doubt
that this is possible.
