Hi.  One of the categories that can be excluded from Consolidated Billing is emergency services.  They have to be "emergent" (42 CFR Section 424.101 "services that are necessary to prevent death or serious impairment of health and because of the danger to life or health require the use of the most accessible hospital available and equipped to furnish those services") and they have to be furnished on an outpatient basis by a hospital or a critical access hospital.  Here's a reference:
On page 4 there is a listing titled "Clarification of Ambulance Services".
From what you described, my guess is that your facility would not be responsible for paying this bill.

Scenario;
A Part A resident develops a suspected DVT and is ordered to the local acute hospital for ultrasound. Since the woman is on strict bedrest, she is transported via gurney by our local transport company.
Resident returns and our Administrator states family must pay for this transport!
Is this legal?
