This is a state-specific licensing issue.  In most states (including CA), LPNs/LVNs are permitted by their licenses to collect assessment data but are not permitted to analyze the data, draw conclusions, and develop care plans (they are permitted to contribute to care plans).

LPNs and LVNs are the backbone of the RAI process in many facilities in this country, collecting and analyzing the data and drawing conclusions (via the MDS as a screening tool and through the RAPs as further, indepth assessments) as well as developing care plans.  Surveyors in some states have written survey deficiencies on this, for example, under  F-Tag 281 that requires that care and services be provided by appropriate qualified professionals.

I have talked with a couple of states' LVN or LPN licensing agencies about this - they are well aware of the issue and do not anticipate that the scope of practice will be changing in their states to add these tasks to the LVN/LPN license.

That is what I was thinking.  If it is not in the LPN to do an assessment, how can they do an MDS?  
This is nothing against LPN"S ---- The corporation I work for will not allow LPN'S to complete MDS'
Is there any kind of reg on this?  And what is with April 1? Are the rules going to change???
