Would it be acceptable just to document the conversation that you have with the discharge/ nurse regarding times, dates and amounts? Would that suffice to provide the justification? It seems everyone is adjusting what used to be “sharing of data for consistency of care” based on their interpretation and revised policy of HIPAA.

We are having difficulties with the local hospital in regards to not giving us the IV flowsheets or the IV that is signed off on the mar.  The hospital says that they have changed their charting format, and are not signing them off on the mar, instead they are documenting the IV's in nurses notes.  According to them we cannot have access d/t the HIPAA laws.  Several different people have called and were told the same thing..  We even asked if they could cover up the nurses notes and sent just the IV section.

Can someone please send me the documentation on HIPAA stating we have the right to this information so I can forward it to the hospital?

Thx in advance!
