The thread got very long. The bottom line is that it is not acceptable under current interpretation of the rules to make the ARD decision after the acceptable time frame for the ARD. I would still argue the reasonableness of the interpretation and will continue to request CMS change it, but for now we are stuck with it.

Unless I'm entirely missing the original question of this thread, WHEN we select the ARD IS the point her i.e. can you chose the ARD after the window has closed.
